| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 51.980, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (c-1) to read as follows: |
|---|
| 13 | 13 | | (c-1) An intercollegiate athletic team sponsored or |
|---|
| 14 | 14 | | authorized by an out-of-state postsecondary educational |
|---|
| 15 | 15 | | institution may not compete in an intercollegiate athletic |
|---|
| 16 | 16 | | competition against an intercollegiate athletic team sponsored or |
|---|
| 17 | 17 | | authorized by an institution of higher education unless the |
|---|
| 18 | 18 | | out-of-state institution, not later than the 30th day before the |
|---|
| 19 | 19 | | date of the athletic competition, certifies to the institution of |
|---|
| 20 | 20 | | higher education that the out-of-state institution will comply with |
|---|
| 21 | 21 | | the requirements of Subsection (b) during the athletic competition. |
|---|
| 22 | 22 | | SECTION 2. Section 51.980(c-1), Education Code, as added by |
|---|
| 23 | 23 | | this Act, applies beginning with intercollegiate athletic |
|---|
| 24 | 24 | | competitions sponsored or authorized by a public institution of |
|---|
| 25 | 25 | | higher education for the 2025-2026 academic year. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2025. |
