77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to allowing pregnant individuals to vote by mail if they
1010 will be in the second or third trimester on election day.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 82.002, Election Code, is
1313 amended to read as follows:
1414 Sec. 82.002. DISABILITY OR OTHER PHYSICAL CONDITION
1515 [CONFINEMENT FOR CHILDBIRTH].
1616 SECTION 2. Section 82.002(a), Election Code, is amended to
1717 read as follows:
1818 (a) A qualified voter is eligible for early voting by mail
1919 if the voter:
2020 (1) has a sickness or physical condition that prevents
2121 the voter from appearing at the polling place on election day
2222 without a likelihood of needing personal assistance or of injuring
2323 the voter's health; [or]
2424 (2) is expecting to give birth within four [three]
2525 weeks before or after election day; or
2626 (3) will be in the second or third trimester of
2727 pregnancy on election day.
2828 SECTION 3. This Act takes effect September 1, 2025.
