77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the amendment of an existing comprehensive development
1010 agreement for a portion of State Highway 130 to facilitate
1111 nontolled transportation projects.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 223.208, Transportation Code, is amended
1414 by adding Subsections (i), (j), and (k) to read as follows:
1515 (i) Notwithstanding Subsection (h), the department shall
1616 amend a comprehensive development agreement entered into on or
1717 before March 22, 2007, for State Highway 130 from U.S. Highway 183
1818 to Interstate Highway 10 (Segments 5 and 6) to extend the term of
1919 the agreement for up to 20 additional years if the amendment:
2020 (1) outlines the public benefit to be derived from
2121 extending the term; and
2222 (2) requires the private participant to provide
2323 consideration in the manner or amount agreed to by the department
2424 and the private participant in accordance with the requirements of
2525 the amendment.
2626 (j) Any funds received under Subsection (i)(2) must be used
2727 by the department, or on behalf of the department using the
2828 department's procurement process, for the design, financing,
2929 construction, maintenance, and operation of nontolled
3030 transportation projects between Interstate Highway 35 and State
3131 Highway 130 to be located wholly or partly in a county in which the
3232 project that is the subject of the comprehensive development
3333 agreement described by Subsection (i) is located. Each nontolled
3434 transportation project under this subsection must be approved by
3535 the county in which the project is located before the expenditure of
3636 funds by the department or on the department's behalf.
3737 (k) Not later than December 1, 2026, the department shall
3838 report on the implementation of the amendment to the comprehensive
3939 development agreement described by Subsection (i) to the presiding
4040 officer of each standing committee of the legislature with primary
4141 jurisdiction over the department. This subsection expires
4242 September 1, 2027.
4343 SECTION 2. This Act takes effect September 1, 2025.
