| 10 | 10 | | agreement for a portion of State Highway 130 to facilitate |

| 11 | 11 | | nontolled transportation projects. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 223.208, Transportation Code, is amended |
|---|
| 14 | 14 | | by adding Subsections (i), (j), and (k) to read as follows: |
|---|
| 15 | 15 | | (i) Notwithstanding Subsection (h), the department shall |
|---|
| 16 | 16 | | amend a comprehensive development agreement entered into on or |
|---|
| 17 | 17 | | before March 22, 2007, for State Highway 130 from U.S. Highway 183 |
|---|
| 18 | 18 | | to Interstate Highway 10 (Segments 5 and 6) to extend the term of |
|---|
| 19 | 19 | | the agreement for up to 20 additional years if the amendment: |
|---|
| 20 | 20 | | (1) outlines the public benefit to be derived from |
|---|
| 21 | 21 | | extending the term; and |
|---|
| 22 | 22 | | (2) requires the private participant to provide |
|---|
| 23 | 23 | | consideration in the manner or amount agreed to by the department |
|---|
| 24 | 24 | | and the private participant in accordance with the requirements of |
|---|
| 25 | 25 | | the amendment. |
|---|
| 26 | 26 | | (j) Any funds received under Subsection (i)(2) must be used |
|---|
| 27 | 27 | | by the department, or on behalf of the department using the |
|---|
| 28 | 28 | | department's procurement process, for the design, financing, |
|---|
| 29 | 29 | | construction, maintenance, and operation of nontolled |
|---|
| 30 | 30 | | transportation projects between Interstate Highway 35 and State |
|---|
| 31 | 31 | | Highway 130 to be located wholly or partly in a county in which the |
|---|
| 32 | 32 | | project that is the subject of the comprehensive development |
|---|
| 33 | 33 | | agreement described by Subsection (i) is located. Each nontolled |
|---|
| 34 | 34 | | transportation project under this subsection must be approved by |
|---|
| 35 | 35 | | the county in which the project is located before the expenditure of |
|---|
| 36 | 36 | | funds by the department or on the department's behalf. |
|---|
| 37 | 37 | | (k) Not later than December 1, 2026, the department shall |
|---|
| 38 | 38 | | report on the implementation of the amendment to the comprehensive |
|---|
| 39 | 39 | | development agreement described by Subsection (i) to the presiding |
|---|
| 40 | 40 | | officer of each standing committee of the legislature with primary |
|---|
| 41 | 41 | | jurisdiction over the department. This subsection expires |
|---|
| 42 | 42 | | September 1, 2027. |
|---|
| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2025. |
