| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article 19A.105(b), Code of Criminal Procedure, |
|---|
| 12 | 12 | | is amended to read as follows: |
|---|
| 13 | 13 | | (b) The following qualified persons may be excused from |
|---|
| 14 | 14 | | grand jury service: |
|---|
| 15 | 15 | | (1) a person older than 70 years of age; |
|---|
| 16 | 16 | | (2) a person responsible for the care of a child |
|---|
| 17 | 17 | | younger than 18 years of age; |
|---|
| 18 | 18 | | (3) a student of a public or private secondary school; |
|---|
| 19 | 19 | | (4) a person enrolled in and in actual attendance at an |
|---|
| 20 | 20 | | institution of higher education; [and] |
|---|
| 21 | 21 | | (5) a person who is a legislative employee, as defined |
|---|
| 22 | 22 | | by Section 306.008, Government Code, if the service would occur |
|---|
| 23 | 23 | | during a legislative session; and |
|---|
| 24 | 24 | | (6) any other person the court determines has a |
|---|
| 25 | 25 | | reasonable excuse from service. |

| 26 | 26 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 27 | 27 | | a grand jury proceeding that begins on or after the effective date |
|---|
| 28 | 28 | | of this Act. A grand jury proceeding that begins before the |
|---|
| 29 | 29 | | effective date of this Act is governed by the law in effect on the |
|---|
| 30 | 30 | | date the proceeding began, and the former law is continued in effect |
|---|
| 31 | 31 | | for that purpose. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2025. |
