77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to excuses from grand jury service.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 19A.105(b), Code of Criminal Procedure,
1212 is amended to read as follows:
1313 (b) The following qualified persons may be excused from
1414 grand jury service:
1515 (1) a person older than 70 years of age;
1616 (2) a person responsible for the care of a child
1717 younger than 18 years of age;
1818 (3) a student of a public or private secondary school;
1919 (4) a person enrolled in and in actual attendance at an
2020 institution of higher education; [and]
2121 (5) a person who is a legislative employee, as defined
2222 by Section 306.008, Government Code, if the service would occur
2323 during a legislative session; and
2424 (6) any other person the court determines has a
2525 reasonable excuse from service.
2626 SECTION 2. The changes in law made by this Act apply only to
2727 a grand jury proceeding that begins on or after the effective date
2828 of this Act. A grand jury proceeding that begins before the
2929 effective date of this Act is governed by the law in effect on the
3030 date the proceeding began, and the former law is continued in effect
3131 for that purpose.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
