77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to permitted forms of identification for the purpose of
1010 accepting a voter.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 63.0101(a), Election Code, is amended to
1313 read as follows:
1414 (a) The following documentation is an acceptable form of
1515 photo identification under this chapter:
1616 (1) one of the following forms of identification
1717 issued to the person by the Department of Public Safety that has not
1818 expired or that expired no earlier than one year before the date of
1919 presentation:
2020 (A) a driver's license, not including a driver's
2121 license subject to Section 521.271(a-2), 521.271(a-3),
2222 521.271(a-4), or 521.2711(c), Transportation Code;
2323 (B) an election identification certificate;[,]
2424 or
2525 (C) a personal identification card [issued to the
2626 person by the Department of Public Safety that has not expired or
2727 that expired no earlier than four years before the date of
2828 presentation];
2929 (2) a United States military identification card that
3030 contains the person's photograph that has not expired or that
3131 expired no earlier than four years before the date of presentation;
3232 (3) a United States citizenship certificate issued to
3333 the person that contains the person's photograph;
3434 (4) a United States passport book or card issued to the
3535 person that has not expired or that expired no earlier than four
3636 years before the date of presentation; or
3737 (5) a license to carry a handgun issued to the person
3838 by the Department of Public Safety that has not expired or that
3939 expired no earlier than four years before the date of presentation.
4040 SECTION 2. The changes in law made by this Act apply only to
4141 an election ordered on or after the effective date of this Act.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
