77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the duration of a protective order against family
1010 violence.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 85.025(a-1), Family Code, is amended to
1313 read as follows:
1414 (a-1) The court may render a protective order applying only
1515 to a person found to have committed family violence sufficient to
1616 protect the applicant and members of the applicant's family or
1717 household that is effective for a period that exceeds two years and
1818 may be for the lives of the persons protected by the protective
1919 order and the person who is the subject of the protective order [if
2020 the court finds that the person who is the subject of the protective
2121 order:
2222 [(1) committed an act constituting a felony offense
2323 involving family violence against the applicant or a member of the
2424 applicant's family or household, regardless of whether the person
2525 has been charged with or convicted of the offense;
2626 [(2) caused serious bodily injury to the applicant or
2727 a member of the applicant's family or household; or
2828 [(3) was the subject of two or more previous
2929 protective orders rendered:
3030 [(A) to protect the person on whose behalf the
3131 current protective order is sought; and
3232 [(B) after a finding by the court that the
3333 subject of the protective order has committed family violence].
3434 SECTION 2. Section 85.001(d), Family Code, is repealed.
3535 SECTION 3. The change in law made by this Act applies only
3636 to a protective order rendered on or after the effective date of
3737 this Act. A protective order rendered before the effective date of
3838 this Act is governed by the law in effect on the date the order is
3939 rendered, and the former law is continued in effect for that
4040 purpose.
4141 SECTION 4. This Act takes effect September 1, 2025.
