| 9 | 9 | | relating to the duration of a protective order against family |

|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 85.025(a-1), Family Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a-1) The court may render a protective order applying only |
|---|
| 15 | 15 | | to a person found to have committed family violence sufficient to |
|---|
| 16 | 16 | | protect the applicant and members of the applicant's family or |
|---|
| 17 | 17 | | household that is effective for a period that exceeds two years and |
|---|
| 18 | 18 | | may be for the lives of the persons protected by the protective |
|---|
| 19 | 19 | | order and the person who is the subject of the protective order [if |
|---|
| 20 | 20 | | the court finds that the person who is the subject of the protective |
|---|
| 21 | 21 | | order: |
|---|
| 22 | 22 | | [(1) committed an act constituting a felony offense |
|---|
| 23 | 23 | | involving family violence against the applicant or a member of the |
|---|
| 24 | 24 | | applicant's family or household, regardless of whether the person |
|---|
| 25 | 25 | | has been charged with or convicted of the offense; |
|---|
| 26 | 26 | | [(2) caused serious bodily injury to the applicant or |
|---|
| 27 | 27 | | a member of the applicant's family or household; or |
|---|
| 28 | 28 | | [(3) was the subject of two or more previous |
|---|
| 29 | 29 | | protective orders rendered: |
|---|
| 30 | 30 | | [(A) to protect the person on whose behalf the |
|---|
| 31 | 31 | | current protective order is sought; and |
|---|
| 32 | 32 | | [(B) after a finding by the court that the |
|---|
| 33 | 33 | | subject of the protective order has committed family violence]. |
|---|
| 34 | 34 | | SECTION 2. Section 85.001(d), Family Code, is repealed. |
|---|
| 35 | 35 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 36 | 36 | | to a protective order rendered on or after the effective date of |
|---|
| 37 | 37 | | this Act. A protective order rendered before the effective date of |
|---|
| 38 | 38 | | this Act is governed by the law in effect on the date the order is |
|---|
| 39 | 39 | | rendered, and the former law is continued in effect for that |
|---|
| 40 | 40 | | purpose. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect September 1, 2025. |
