611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the revocation of an occupational license from certain
914 license holders and the issuance of a provisional occupational
1015 license to certain applicants with criminal convictions.
1116 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 53.021, Occupations Code, is amended by
13- adding Subsection (a-2) and amending Subsection (b) to read as
14- follows:
15- (a-2) A licensing authority may revoke a license holder's
16- license on the grounds of the license holder's imprisonment
17- following a felony conviction.
17+ SECTION 1. Section 53.021(b), Occupations Code, is amended
18+ to read as follows:
1819 (b) A license holder's license shall be revoked on the
1920 license holder's imprisonment following a:
2021 (1) felony conviction for:
2122 (A) an offense that directly relates to the
2223 duties and responsibilities of the licensed occupation;
2324 (B) an offense listed in Article 42A.054, Code of
2425 Criminal Procedure; or
2526 (C) a sexually violent offense, as defined by
2627 Article 62.001, Code of Criminal Procedure;
2728 (2) [,] felony community supervision revocation;
2829 (3) [,] revocation of parole; [,] or
2930 (4) revocation of mandatory supervision.
3031 SECTION 2. Section 53.0211, Occupations Code, is amended by
3132 amending Subsections (b) and (c) and adding Subsections (b-1) and
3233 (h) to read as follows:
3334 (b) Notwithstanding any law other than Subsection (a) and
3435 unless the applicant has been convicted of an offense described by
3536 Section 53.021(a), a licensing authority shall issue to an
3637 otherwise qualified applicant who has been convicted of an offense:
3738 (1) the license for which the applicant applied; or
3839 (2) a provisional license under Subsection (b-1) valid
3940 for a term of 12 months [described by Subsection (c)].
4041 (b-1) A licensing authority may issue a provisional license
41- to an applicant who has been convicted of an offense, including an
42- applicant who:
42+ to an applicant who:
4343 (1) is:
4444 (A) an inmate imprisoned in the Texas Department
4545 of Criminal Justice; or
4646 (B) a person released on parole or mandatory
4747 supervision and residing at a place described by Section 508.118 or
4848 508.119, Government Code; and
4949 (2) is enrolled in or has completed an educational
5050 program offered by:
5151 (A) the Windham School District; or
5252 (B) an institution of higher education, as
5353 defined by Section 61.003, Education Code.
5454 (c) The term of a provisional license issued to an applicant
5555 who is an inmate imprisoned in the Texas Department of Criminal
5656 Justice begins on the date the applicant is released [A licensing
5757 authority may issue a provisional license for a term of six months
5858 to an applicant who has been convicted of an offense].
5959 (h) On request of a licensing authority, the Texas
6060 Department of Criminal Justice shall provide to the licensing
6161 authority information regarding an applicant who is an inmate
6262 imprisoned in the Texas Department of Criminal Justice for purposes
6363 of determining the inmate's eligibility for a license.
6464 SECTION 3. Section 508.313(c), Government Code, is amended
6565 to read as follows:
6666 (c) The department, on request or in the normal course of
6767 official business, shall provide information that is confidential
6868 and privileged under Subsection (a) to:
6969 (1) the governor;
7070 (2) a member of the board or a parole commissioner;
7171 (3) the Criminal Justice Policy Council in performing
7272 duties of the council under Section 413.017; [or]
7373 (4) a licensing authority requesting information
7474 concerning an inmate or releasee who has submitted an application
7575 for an occupational license to the licensing authority; or
7676 (5) an eligible entity requesting information for a
7777 law enforcement, prosecutorial, correctional, clemency, or
7878 treatment purpose.
7979 SECTION 4. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2025.
