77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the representation of an indigent person in certain
1010 criminal proceedings in certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article 26.04, Code of Criminal Procedure, is
1313 amended by adding Subsection (i-1) to read as follows:
1414 (i-1) This subsection applies only to a county with a
1515 population of 2.5 million or more that is adjacent to a county with
1616 a population of more than 2.1 million. Notwithstanding Subsection
1717 (j)(2) or any other law, and if funds are appropriated by a county
1818 for this purpose, an attorney may be appointed under this article to
1919 represent an indigent person for the sole purpose of providing
2020 counsel in relation to that person's appearance before a magistrate
2121 as required by Article 14.06(a), 15.17(a), or 15.18(a). The
2222 attorney may represent the person in subsequent proceedings of that
2323 case, only if appointed for that purpose under the other provisions
2424 of this article.
2525 SECTION 2. Article 26.04(i-1), Code of Criminal Procedure,
2626 as added by this Act, applies only to a person who is arrested on or
2727 after the effective date of this Act. A person arrested before the
2828 effective date of this Act is governed by the law in effect on the
2929 date the person was arrested, and the former law is continued in
3030 effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2025.
