12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Subchapter A, Chapter 29, Education Code, is | |
14 | 14 | amended by adding Section 29.030 to read as follows: | |
15 | 15 | Sec. 29.030. REFERRAL TO LOCAL INTELLECTUAL AND | |
16 | 16 | DEVELOPMENTAL DISABILITY AUTHORITY. A school district shall refer | |
17 | 17 | each student who qualifies to receive special education services | |
18 | 18 | under this subchapter on the basis of a diagnosed or suspected | |
19 | 19 | intellectual or developmental disability to a local intellectual | |
20 | 20 | and developmental disability authority for services or public | |
21 | 21 | benefits, including services under a Medicaid waiver program | |
22 | 22 | established under Section 1915(c), Social Security Act (42 U.S.C. | |
23 | 23 | Section 1396n(c)). | |
24 | 24 | SECTION 2. This Act applies beginning with the 2025-2026 | |
25 | 25 | school year. | |
26 | 26 | SECTION 3. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2025. |
