77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the referral of certain students receiving special
1010 education services to a local intellectual and developmental
1111 disability authority for services or public benefits.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1414 amended by adding Section 29.030 to read as follows:
1515 Sec. 29.030. REFERRAL TO LOCAL INTELLECTUAL AND
1616 DEVELOPMENTAL DISABILITY AUTHORITY. A school district shall refer
1717 each student who qualifies to receive special education services
1818 under this subchapter on the basis of a diagnosed or suspected
1919 intellectual or developmental disability to a local intellectual
2020 and developmental disability authority for services or public
2121 benefits, including services under a Medicaid waiver program
2222 established under Section 1915(c), Social Security Act (42 U.S.C.
2323 Section 1396n(c)).
2424 SECTION 2. This Act applies beginning with the 2025-2026
2525 school year.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2025.
