77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to procedures and required findings in certain suits
1010 affecting the parent-child relationship.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 263.002, Family Code, is amended by
1313 adding Subsection (c-1) to read as follows:
1414 (c-1) In making the required findings under Subsection (c),
1515 the court shall include the findings in a separate section of its
1616 order and enumerate with specificity the facts and the
1717 circumstances that serve as the basis for the court's findings.
1818 Merely citing the record of the proceedings or incorporating it by
1919 reference is insufficient to meet the requirements of this
2020 subsection.
2121 SECTION 2. Section 263.306, Family Code, is amended by
2222 adding Subsection (a-2) to read as follows:
2323 (a-2) If the court determines under Subsection (a-1)(6)
2424 that the child's parents are unwilling or unable to provide the
2525 child with a safe environment, the court shall include in a separate
2626 section of its order written findings describing with specificity
2727 the facts and the circumstances that serve as the basis for the
2828 court's determination that the child's parents are unwilling or
2929 unable to provide the child with a safe environment. Merely citing
3030 the record of the proceedings or incorporating it by reference is
3131 insufficient to meet the requirements of this subsection.
3232 SECTION 3. The changes in law made by this Act apply to an
3333 action that is pending on or filed on or after the effective date of
3434 this Act.
3535 SECTION 4. This Act takes effect September 1, 2025.
