77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to authorizing the issuance of revenue bonds for certain
1010 capital projects at Sul Ross State University.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1313 amended by adding Section 55.17994 to read as follows:
1414 Sec. 55.17994. SUL ROSS STATE UNIVERSITY; ADDITIONAL BONDS.
1515 (a) In addition to the other authority granted under this
1616 subchapter, the board of regents of the Texas State University
1717 System may acquire, purchase, construct, improve, renovate,
1818 enlarge, or equip property and facilities, including roads and
1919 related infrastructure, for Sul Ross State University for the
2020 expansion of agricultural, life, and physical sciences facilities,
2121 to be financed by the issuance of bonds in accordance with a
2222 systemwide revenue financing program and secured as provided by
2323 that program, in an aggregate principal amount not to exceed
2424 $70,000,000.
2525 (b) The board may pledge irrevocably to the payment of the
2626 bonds authorized by this section all or any part of the revenue
2727 funds of an institution, branch, or entity of the Texas State
2828 University System, including student tuition charges. The amount
2929 of a pledge made under this subsection may not be reduced or
3030 abrogated while the bonds for which the pledge is made, or bonds
3131 issued to refund those bonds, are outstanding.
3232 (c) If sufficient funds are not available to the board to
3333 meet its obligations under this section, the board may transfer
3434 funds among institutions, branches, and entities of the Texas State
3535 University System to ensure the most equitable and efficient
3636 allocation of available resources for each institution, branch, or
3737 entity to carry out its duties and purposes.
3838 SECTION 2. This Act does not affect any authority or
3939 restriction regarding the activities that a public institution of
4040 higher education may conduct in connection with a facility financed
4141 by bonds authorized by this Act.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
