 A BILL TO BE ENTITLED
 AN ACT
 relating to prohibiting the distribution or sale of certain
 flavored consumable hemp products; creating a criminal offense.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter E, Chapter 443, Health and Safety
 Code, is amended by adding Section 443.2055 to read as follows:
 Sec. 443.2055.  DISTRIBUTION OR SALE OF CERTAIN FLAVORED
 CONSUMABLE HEMP PRODUCTS PROHIBITED. (a) A person commits an
 offense if the person knowingly distributes, sells, or possesses
 with intent to distribute or sell a consumable hemp product that is:
 (1)  marketed or packaged to appear similar to a candy
 or beverage product; and
 (2)  modified by flavoring or coloring to appear
 similar to a candy or beverage product.
 (b)  An offense under this section is a felony of the second
 degree.
 SECTION 2.  This Act takes effect September 1, 2025.
