11 | 11 | SECTION 1. The heading to Section 21.165, Penal Code, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | Sec. 21.165. UNLAWFUL PRODUCTION OR DISTRIBUTION OF CERTAIN | |
14 | 14 | SEXUALLY EXPLICIT VISUAL MATERIAL [VIDEOS]. | |
15 | 15 | SECTION 2. Sections 21.165 (a) and (b), Penal Code, are | |
16 | 16 | amended to read as follows: | |
17 | 17 | (a) In this section: | |
18 | 18 | (1) "Deep fake visual material [video]" means visual | |
19 | 19 | material [a video], created with the intent to deceive, that | |
20 | 20 | appears to depict a real person performing an action that did not | |
21 | 21 | occur in reality. | |
22 | 22 | (2) "Intimate parts" and "sexual conduct" have the meanings | |
23 | 23 | assigned by Section 21.16. | |
24 | 24 | (3) "Visual material" has the meaning assigned by Section | |
25 | 25 | 43.26(b)(3), Penal Code. | |
26 | 26 | (b) A person commits an offense if, without the effective | |
27 | 27 | consent of the person appearing to be depicted, the person | |
28 | 28 | knowingly produces or distributes by electronic means a deep fake | |
29 | 29 | visual material [video] that appears to depict the person with the | |
30 | 30 | person's intimate parts exposed or engaged in sexual conduct. | |
31 | 31 | SECTION 3. This Act takes effect September 1, 2025. |
