77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the determination of fees, charges, and rates for
1010 certain benefits under Medicaid.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 32.028(c), Human Resources Code, is
1313 amended to read as follows:
1414 (c) The fee, charge, or rate for other medical assistance is
1515 the usual and customary fee, charge, or rate that prevails in the
1616 community unless the payment is limited by state or federal law. In
1717 determining the usual and customary fee, charge, or rate under this
1818 subsection, the commission shall exclude any fee, charge, or rate
1919 offered as part of a fee-based membership discount program.
2020 SECTION 2. If before implementing any provision of this Act
2121 a state agency determines that a waiver or authorization from a
2222 federal agency is necessary for implementation of that provision,
2323 the agency affected by the provision shall request the waiver or
2424 authorization and may delay implementing that provision until the
2525 waiver or authorization is granted.
2626 SECTION 3. This Act takes effect September 1, 2025.
