88 AN ACT
99 relating to eligibility for the Lone Star Workforce of the Future
1010 Fund grant program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 134A.001, Education Code, is amended by
1313 adding Subdivision (3) to read as follows:
1414 (3) "Qualifying general academic teaching
1515 institution" means a general academic teaching institution as
1616 defined by Section 61.003 that:
1717 (A) has a student enrollment of less than 10,000;
1818 (B) is located in a county with a population of
1919 less than 35,000; and
2020 (C) is designated by the United States Department
2121 of Education as a Minority Serving Institution (MSI).
2222 SECTION 2. Section 134A.006, Education Code, is amended to
2323 read as follows:
2424 Sec. 134A.006. LONE STAR WORKFORCE OF THE FUTURE FUND GRANT
2525 PROGRAM. The commission shall establish and administer the Lone
2626 Star Workforce of the Future Fund grant program to provide grants to
2727 public junior colleges, public technical institutes, qualifying
2828 general academic teaching institutions, and nonprofit
2929 organizations that apply to the commission in the manner prescribed
3030 by the commission and satisfy the eligibility criteria prescribed
3131 by Section 134A.007. The commission shall award the grants on the
3232 advice and recommendations of the advisory board.
3333 SECTION 3. Section 134A.007, Education Code, is amended to
3434 read as follows:
3535 Sec. 134A.007. GRANT ELIGIBILITY. To be eligible to
3636 receive a grant under this chapter, a public junior college, public
3737 technical institute, qualifying general academic teaching
3838 institution, or nonprofit organization must:
3939 (1) administer one or more performance-based
4040 workforce training programs that:
4141 (A) lead to skill development and experiences
4242 required for employment in high demand occupations in at least one
4343 career field identified and listed as a high-growth career field
4444 by:
4545 (i) the commission;
4646 (ii) the Texas Workforce Investment
4747 Council; or
4848 (iii) the Tri-Agency Workforce Initiative
4949 established under Chapter 2308A, Government Code;
5050 (B) are developed and provided based on
5151 consultation with and input from employers who are hiring in high
5252 demand occupations;
5353 (C) create pathways to employment for program
5454 participants; and
5555 (D) are delivered through classroom-based or
5656 online instruction, work-based experiences internships, or
5757 apprenticeships, or through a combination of those methods;
5858 (2) demonstrate through third-party validated data
5959 successful outcomes in:
6060 (A) recruiting local unemployed and
6161 underemployed individuals to participate in the training program or
6262 programs;
6363 (B) training individuals with the skills needed
6464 to secure full-time employment paying at least a self-sufficient
6565 wage as determined under Section 2308A.012, Government Code, in the
6666 relevant job field; and
6767 (C) placing individuals in employment in high
6868 demand occupations;
6969 (3) demonstrate the ability to attract at least 40
7070 percent of the necessary funding for training program operation
7171 from revenue streams other than state government funding; and
7272 (4) agree to:
7373 (A) collaborate with the commission, corporate
7474 partners, and nonprofit educational partners to determine the
7575 training programs to be provided using grant money;
7676 (B) secure support from local businesses to
7777 ensure alignment between training program offerings and in-demand
7878 skills;
7979 (C) collaborate with regional employers, public
8080 junior colleges, public technical institutes, qualifying general
8181 academic teaching institutions, or nonprofit organizations to make
8282 available developmental work-based experiences to further enhance
8383 training program participants' career readiness;
8484 (D) engage local entities and organizations,
8585 including local workforce development boards and community-based
8686 organizations, to assist with identifying and recruiting eligible
8787 training program participants;
8888 (E) provide documentation to the commission
8989 describing training program offerings, including information
9090 necessary to verify that the offerings will:
9191 (i) provide training that is not exclusive
9292 to a single corporate partner; and
9393 (ii) lead to knowledge, skills, and
9494 work-based experiences that are transferable to similar employment
9595 opportunities in high demand occupations offered by other
9696 employers; and
9797 (F) comply with any additional grant conditions
9898 prescribed by commission rule, including performance benchmarks
9999 established under Section 134A.008 and reporting requirements
100100 established under Section 134A.009.
101101 SECTION 4. This Act takes effect immediately if it receives
102102 a vote of two-thirds of all the members elected to each house, as
103103 provided by Section 39, Article III, Texas Constitution. If this
104104 Act does not receive the vote necessary for immediate effect, this
105105 Act takes effect September 1, 2025.
