66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the prosecution and punishment of the offense of theft
99 of petroleum product.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 31.19, Penal Code, is amended by adding
1212 Subsections (e) and (f) to read as follows:
1313 (e) An offense described for purposes of punishment by this
1414 section is increased to the next higher category of offense if it is
1515 shown on the trial of the offense that the actor:
1616 (1) organized, supervised, financed, or managed one or
1717 more other persons engaged in conduct constituting an offense under
1818 this section;
1919 (2) has been previously convicted of an offense under
2020 this section;
2121 (3) in connection with the offense, engaged in conduct
2222 constituting conspiracy under Section 15.02 to commit an offense
2323 under Section 28.03; or
2424 (4) knowingly possessed a firearm during the
2525 commission of the offense.
2626 (e-1) If an offense listed under this section is punishable
2727 as a felony of the first degree, the punishment for that offense may
2828 not be increased under Subsection (e).
2929 (f) If conduct that constitutes an offense under this
3030 section also constitutes an offense under any other law, the actor
3131 may be prosecuted under this section, the other law, or both.
3232 SECTION 2. The changes in law made by this Act apply only to
3333 an offense committed on or after the effective date of this Act. An
3434 offense committed before the effective date of this Act is governed
3535 by the law in effect on the date the offense was committed, and the
3636 former law is continued in effect for that purpose. For purposes of
3737 this section, an offense was committed before the effective date of
3838 this Act if any element of the offense was committed before that
3939 date.
4040 SECTION 3. This Act takes effect September 1, 2025.
