88 AN ACT
99 relating to creating the criminal offense of criminal pursuit.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 15, Penal Code, is amended by adding
1212 Section 15.021 to read as follows:
1313 Sec. 15.021. CRIMINAL PURSUIT. (a) A person commits an
1414 offense if, with the intent to commit an offense under Chapter 29,
1515 an offense under Section 30.04 involving theft, or an offense under
1616 Section 31.03, the person:
1717 (1) knowingly travels from a commercial business or
1818 financial institution, as defined by Section 201.101, Finance Code,
1919 on the same path or route as another person without substantially
2020 deviating from that path or route;
2121 (2) is a member of a criminal street gang, as defined
2222 by Section 71.01; and
2323 (3) is in possession of two or more criminal
2424 instruments, as defined by Section 16.01.
2525 (b) An offense under this section is a felony of the third
2626 degree.
2727 (c) If conduct constituting an offense under this section
2828 also constitutes an offense under another section of this code, the
2929 actor may be prosecuted under either section or under both
3030 sections.
3131 SECTION 2. This Act takes effect September 1, 2025.
