| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 2052, Texas Government Code, is amended |
|---|
| 12 | 12 | | by adding Subchapter E to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER E. PUBLIC USE OF STATE AGENCY FORMS |
|---|
| 14 | 14 | | Sec. 2052.401. DEFINITIONS. In this subchapter "state |
|---|
| 15 | 15 | | agency" means any office, department, commission, board, bureau, |
|---|
| 16 | 16 | | division, institution, or other entity in the executive, |
|---|
| 17 | 17 | | legislative, or judicial branch of state government that was |
|---|
| 18 | 18 | | created by the constitution or a statute of the state. |
|---|
| 19 | 19 | | Sec. 2052.402. PUBLIC USE OF STATE AGENCY FORMS. (a) Any |
|---|
| 20 | 20 | | form created by or on behalf of a state agency that is intended to |
|---|
| 21 | 21 | | facilitate interaction between the public and a state agency may be |
|---|
| 22 | 22 | | freely reproduced, copied, or used by any person, business, |
|---|
| 23 | 23 | | organization, or entity. |
|---|
| 24 | 24 | | (b) No state agency may impose restrictions or conditions on |
|---|
| 25 | 25 | | the reproduction or use of such forms by the public, except as |
|---|
| 26 | 26 | | necessary to ensure compliance with applicable state or federal |
|---|
| 27 | 27 | | law. |
|---|
| 28 | 28 | | (c) This section does not authorize alteration of the |
|---|
| 29 | 29 | | content of a form that would render it inaccurate or noncompliant |
|---|
| 30 | 30 | | with applicable state or federal law. |
|---|
| 31 | 31 | | (d) This section does not require any agency to provide |
|---|
| 32 | 32 | | copies of forms. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect September 1, 2025. |
