| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. The heading to Section 352.0165, Local |
|---|
| 12 | 12 | | Government Code, is amended to read as follows: |
|---|
| 13 | 13 | | Sec. 352.0165. INSPECTION OF GROUP HOMES [IN CERTAIN |

| 14 | 14 | | COUNTIES]; FEE. |
|---|
| 15 | 15 | | SECTION 2. Section 352.0165(a)(1), Local Government Code, |
|---|
| 16 | 16 | | is amended to read as follows: |
|---|
| 17 | 17 | | (1) "Group home" has the meaning assigned by Section |
|---|
| 18 | 18 | | 769.001, Health and Safety Code, as added by Chapter 141 (S.B. 188), |
|---|
| 19 | 19 | | Acts of the 88th Legislature, Regular Session, 2023 [means an |
|---|
| 20 | 20 | | establishment: |
|---|
| 21 | 21 | | [(A) in which three or more individuals who are |
|---|
| 22 | 22 | | unrelated to the owner or operator of the establishment reside; |
|---|
| 23 | 23 | | [(B) that provides residential care services to |
|---|
| 24 | 24 | | residents; and |
|---|
| 25 | 25 | | [(C) that receives payment or other compensation |
|---|
| 26 | 26 | | from a local, state, or federal governmental entity for providing |
|---|
| 27 | 27 | | residential care services to a resident]. |

| 28 | 28 | | SECTION 3. Section 352.0165(b), Local Government Code, is |
|---|
| 29 | 29 | | repealed. |
|---|
| 30 | 30 | | SECTION 4. It is the intent of the 89th Legislature, Regular |
|---|
| 31 | 31 | | Session, 2025, that the amendments made by this Act be harmonized |
|---|
| 32 | 32 | | with another Act of the 89th Legislature, Regular Session, 2025, |
|---|
| 33 | 33 | | relating to nonsubstantive additions to and corrections in enacted |
|---|
| 34 | 34 | | codes. |
|---|
| 35 | 35 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2025. |
