15- relating to first responder policies for emergencies occurring at a
16- group home in certain municipalities and counties.
9+ relating to municipal first responder policies for emergencies
10+ occurring at a group home.
1711 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
18- SECTION 1. Chapter 370, Local Government Code, is amended
19- by adding Section 370.010 to read as follows:
20- Sec. 370.010. GROUP HOME POLICIES IN CERTAIN MUNICIPALITIES
21- AND COUNTIES. (a) In this section, "group home" has the meaning
22- assigned by Section 769.001, Health and Safety Code, as added by
23- Chapter 141 (S.B. 188), Acts of the 88th Legislature, Regular
24- Session, 2023.
25- (b) This section applies only to a municipality wholly or
26- partly located in a county with a population of more than 300,000
27- and a county with a population of more than 300,000.
28- (c) A municipal or county law enforcement agency, a
29- municipal or county fire department, and any other municipal or
30- county department providing emergency medical services shall
31- develop policies to respond to an emergency occurring at a group
32- home, regardless of whether the group home holds a license. In
33- developing a policy under this subsection, a municipal or county
34- department shall establish any procedures necessary for an
35- efficient response to an emergency after considering the nature of
36- group homes.
37- SECTION 2. It is the intent of the 89th Legislature, Regular
38- Session, 2025, that the amendments made by this Act to Chapter 370,
39- Local Government Code, be harmonized with another Act of the 89th
40- Legislature, Regular Session, 2025, relating to nonsubstantive
41- additions to and corrections in enacted codes.
42- SECTION 3. This Act takes effect September 1, 2025.

12+ SECTION 1. Subtitle A, Title 11, Local Government Code, is
13+ amended by adding Chapter 349 to read as follows:
14+ CHAPTER 349. MISCELLANEOUS PROVISIONS RELATED TO MUNICIPAL PUBLIC
15+ SAFETY
16+ Sec. 349.001. GROUP HOME POLICIES. (a) In this section,
17+ "group home" has the meaning assigned by Section 769.001, Health
18+ and Safety Code.
19+ (b) A municipal police department, a municipal fire
20+ department, and any other municipal department providing emergency
21+ medical services shall develop policies to respond to an emergency
22+ occurring at a group home, regardless of whether the group home
23+ holds a license. In developing a policy under this subsection, a
24+ municipal department shall establish any procedures necessary for
25+ an efficient response to an emergency after considering the nature
26+ of group homes.
27+ SECTION 2. This Act takes effect September 1, 2025.
