159 relating to certain planning, notification, and evaluation
16- requirements with respect to certain workforce development
17- programs in this state.

1812 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1913 SECTION 1. Section 2308.304, Government Code, is amended by
2014 adding Subsection (c-1) to read as follows:
2115 (c-1) In establishing goals, objectives, and performance
2216 measures for segments of the population under Subsection (c), the
2317 plan must establish specific goals, objectives, and performance
24- measures for individuals who are at least 14 years of age but
18+ measures for individuals who are at least 16 years of age but
2519 younger than 25 years of age.
2620 SECTION 2. Chapter 2308, Government Code, is amended by
2721 adding Subchapter H to read as follows:
2822 SUBCHAPTER H. DUTIES OF GOVERNMENTAL ENTITIES TO LOCAL WORKFORCE
2923 DEVELOPMENT BOARDS AND DIVISION
3024 Sec. 2308.351. NOTICE OF FINANCIAL INCENTIVE. (a) In this
3125 section:
3226 (1) "Commission" means the Texas Workforce
3327 Commission.
3428 (2) "Financial incentive" means a financial benefit,
3529 including a grant, loan, or tax preference, or a combination of
3630 those benefits, offered by a governmental entity to any person.
3731 (3) "Governmental entity" means a state agency or
3832 political subdivision of this state, including a municipality or
3933 county.
4034 (b) A governmental entity that provides a financial
4135 incentive that results in the creation of at least 100 estimated new
4236 employment opportunities shall, not later than the 30th day after
4337 the date the governmental entity approves the financial incentive,
4438 notify the commission and any local workforce development board
4539 operating in a workforce development area where the financial
4640 incentive is distributed of the plan to distribute the financial
4741 incentive.
4842 (c) The notice required by Subsection (b) must include:
4943 (1) the estimated number of new employment
5044 opportunities the financial incentive will create;
5145 (2) the estimated start date for each new employment
5246 opportunity created by the financial incentive; and
5347 (3) a description of the skills and training necessary
5448 for applicants for each new employment opportunity created by the
5549 financial incentive.
5650 SECTION 3. Subchapter E, Chapter 302, Labor Code, is
5751 amended by adding Section 302.087 to read as follows:
5852 Sec. 302.087. EVALUATION OF WORKFORCE DEVELOPMENT
59- ACTIVITIES. (a) In this section, "federally funded youth program"
60- means a youth workforce development program funded under Title I of
61- the Workforce Innovation and Opportunity Act (29 U.S.C. Section
62- 3101 et seq.).
63- (b) The commission shall annually evaluate:
64- (1) the effectiveness of the commission's federally
65- funded youth programs; and
66- (2) the best practices for local workforce development
67- boards to:
53+ ACTIVITIES. (a) The commission shall annually evaluate:
54+ (1) the effectiveness of the commission's workforce
55+ development program; and
56+ (2) the best practices for allocating workforce
57+ development funds to and by local workforce development boards to:
6858 (A) meet the current and projected workforce
6959 needs of employers in workforce development areas; and
7060 (B) provide workforce development services to
71- individuals who are at least 14 years of age but younger than 25
61+ individuals who are at least 16 years of age but younger than 25
7262 years of age.
73- (c) The evaluation under Subsection (b) must include:
74- (1) a calculation of the total percentage of workforce
75- funds spent annually through the commission's federally funded
76- youth programs on efforts to:

64+ (1) a calculation of the respective percentages of
65+ workforce funds spent annually on efforts to:
7766 (A) increase employment among individuals who
78- are at least 14 years of age but younger than 25 years of age;
67+ are at least 16 years of age but younger than 25 years of age;
7968 (B) reenroll individuals who have dropped out of
80- a public or open-enrollment charter school and who are at least 14
69+ a public or open-enrollment charter school and who are at least 16
8170 years of age but younger than 25 years of age; and
8271 (C) facilitate the participation of individuals
83- who are at least 14 years of age but younger than 25 years of age in
72+ who are at least 16 years of age but less than 25 years of age in
8473 postsecondary education, technical education, or the military;
8574 (2) the respective numbers of individuals who are at
86- least 14 years of age but younger than 25 years of age who:
75+ least 16 years of age but younger than 25 years of age who:
8776 (A) have dropped out of a public or
8877 open-enrollment charter school and are assisted in reenrollment
8978 with workforce funds; and
9079 (B) receive assistance in participating in
9180 postsecondary education, technical education, or the military;
9281 (3) for each local workforce development area:
9382 (A) the respective numbers of individuals who are
94- at least 14 years of age but younger than 25 years of age who:
83+ at least 16 years of age but younger than 25 years of age who:
9584 (i) are eligible for workforce development
9685 services; and
9786 (ii) annually receive workforce
9887 development services, including the number receiving assistance in
9988 enrolling in high school, a high school equivalency program, an
10089 apprenticeship program, an institution of higher education, a
10190 technical school, or the military; and
10291 (B) the total number of workforce development
103- service providers actively serving individuals who are at least 14
104- years of age but younger than 25 years of age in the area through the
105- commission's federally funded youth programs;
92+ service providers actively serving individuals who are at least 16
93+ years of age but younger than 25 years of age in the area;
10694 (4) for each local workforce development board, an
10795 assessment of the board's current use of workforce funds to
10896 determine and meet the current and projected workforce needs of
10997 employers in the workforce development area;
11098 (5) examples of efforts to reach individuals who are
111- at least 14 years of age but younger than 25 years of age in which
112- the commission and local workforce development boards coordinated
113- with each of the following respective entities:
99+ at least 16 years of age but less than 25 years of age in which the
100+ commission and local workforce development boards coordinated with
101+ each of the following respective entities:
114102 (A) the Texas Education Agency, school
115103 districts, or open-enrollment charter schools;
116104 (B) the Texas Higher Education Coordinating
117105 Board or institutions of higher education; and
118106 (C) the Department of Family and Protective
119107 Services; and
120108 (6) examples of efforts to meet current and projected
121109 workforce needs in which the commission and local workforce
122110 development boards coordinated with each of the following
123111 respective entities:
124112 (A) private employers or other members of the
125113 business community; and
126114 (B) workforce development service providers.
127- (d) The commission shall make the evaluation conducted
128- under Subsection (b), any information collected in the course of

139- who are at least 14 years of age but younger than 25 years of age,

141129 (3) an analysis of multiyear trends identifiable from
142130 the information contained in the evaluation conducted under
143- Subsection (b), including any identifiable trends that show
144- positive impacts of the commission's federally funded youth
145- programs on workforce participation of individuals who are at least
146- 14 years of age but younger than 25 years of age; and
131+ Subsection (a), including any identifiable trends that show
132+ positive impacts of workforce development programs on workforce
133+ participation of individuals who are at least 16 years of age but
134+ less than 25 years of age; and
147135 (4) the commission's recommendation for legislative or
148136 regulatory action, including recommendations for regulatory action
149137 by other governmental entities.
150138 SECTION 4. This Act takes effect September 1, 2025.
