69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the authority of the Texas Commission on Environmental
912 Quality to issue permits for the land application of water produced
1013 from certain mining and oil and gas extraction operations.
1114 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1215 SECTION 1. Section 26.131, Water Code, as effective until
1316 delegation of authority under the Resource Conservation and
1417 Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.) to the
1518 Railroad Commission of Texas, is amended by amending Subsection (b)
1619 and adding Subsection (e) to read as follows:
1720 (b) Except as provided by Subsections [Subsection] (d) and
1821 (e), the Railroad Commission of Texas may issue permits for the
1922 discharge of waste resulting from the activities described by
2023 Subsection (a), and the discharge of waste into water in this state
2124 resulting from those activities must meet the water quality
2225 standards established by the commission.
2326 (e) The commission may issue permits for the land
2427 application of produced water resulting from activities described
2528 by Subsection (a) that has been treated for beneficial use. The
2629 commission shall adopt standards for the land application of water
2730 under this section, including standards that prevent the pollution
2831 of surface and subsurface water.
2932 SECTION 2. Section 26.131, Water Code, as effective on
3033 delegation of authority under the Resource Conservation and
3134 Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.) to the
3235 Railroad Commission of Texas, is amended by amending Subsection (b)
3336 and adding Subsection (d) to read as follows:
3437 (b) Except as provided by Subsections [Subsection] (c) and
3538 (d), the Railroad Commission of Texas may issue permits for the
3639 discharge of waste resulting from the activities described by
3740 Subsection (a), and the discharge of waste into water in this state
3841 resulting from those activities must meet the water quality
3942 standards established by the commission.
4043 (d) The commission may issue permits for the land
4144 application of produced water resulting from activities described
4245 by Subsection (a) that has been treated for beneficial use. The
4346 commission shall adopt standards for the land application of water
4447 under this section, including standards that prevent the pollution
4548 of surface and subsurface water.
4649 SECTION 3. The change in law made by this Act applies only
4750 to a permit, the application for which is filed on or after the
4851 effective date of this Act. A permit, the application for which is
4952 filed before the effective date of this Act, is subject to the law
5053 in effect on the date the application is filed, and that law is
5154 continued in effect for that purpose.
5255 SECTION 4. This Act takes effect September 1, 2025.
