77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a prohibition on weather and climate modification
1010 activities by a governmental entity.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 301, Agriculture Code, is
1313 amended by adding Section 301.002 to read as follows:
1414 Sec. 301.002. WEATHER OR CLIMATE MODIFICATION BY
1515 GOVERNMENTAL ENTITY PROHIBITED. (a) In this section,
1616 "geoengineering" means the intentional injection, release, or
1717 dispersion, by any means, of chemicals, chemical compounds,
1818 substances, or apparatus into the atmosphere with the express
1919 purpose of affecting temperature, weather, or the intensity of
2020 sunlight.
2121 (b) Notwithstanding any other law, a governmental entity
2222 may not engage in geoengineering, weather modification and control,
2323 or cloud-seeding operations.
2424 SECTION 2. Section 301.057, Agriculture Code, is amended to
2525 read as follows:
2626 Sec. 301.057. [CONTRACTS AND] COOPERATIVE AGREEMENTS.
2727 [(a)] The Texas Department of Licensing and Regulation may
2828 cooperate with [public or] private agencies to promote the purposes
2929 of this chapter.
3030 [(b) The Texas Department of Licensing and Regulation may
3131 enter into cooperative agreements with the United States or any of
3232 its agencies, with counties and municipalities of this state, or
3333 with any private or public agencies for conducting weather
3434 modification or cloud-seeding operations.
3535 [(c) The Texas Department of Licensing and Regulation may
3636 represent the state, counties, municipalities, and public and
3737 private agencies in contracting with private concerns for the
3838 performance of weather modification or cloud-seeding operations.]
3939 SECTION 3. Section 301.102(a), Agriculture Code, is amended
4040 to read as follows:
4141 (a) The Texas Department of Licensing and Regulation by
4242 rule, to the extent it considers exemptions practical, shall
4343 provide for exempting the following activities from the license and
4444 permit requirements of this chapter:
4545 (1) research, development, and experiments conducted
4646 by private [state and federal agencies,] institutions of higher
4747 learning[,] and bona fide nonprofit research organizations;
4848 (2) laboratory research and experiments;
4949 (3) activities of an emergent nature for protection
5050 against fire, frost, sleet, or fog; and
5151 (4) activities normally conducted for purposes other
5252 than inducing, increasing, decreasing, or preventing precipitation
5353 or hail.
5454 SECTION 4. The following provisions of the Agriculture
5555 Code are repealed:
5656 (1) Section 301.056;
5757 (2) Section 301.058(b); and
5858 (3) Chapter 302.
5959 SECTION 5. The changes in law made by this Act apply only to
6060 a contract entered into on or after the effective date of this Act.
6161 A contract entered into before the effective date of this Act is
6262 governed by the law in effect on the date the contract was entered
6363 into, and the former law is continued in effect for that purpose.
6464 SECTION 6. This Act takes effect September 1, 2025.
