77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the repeal of the temporary tax reduction for certain
1010 high-cost gas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 81.117(d), Natural Resources Code, is
1313 amended to read as follows:
1414 (d) The exemptions and reductions set out in Sections
1515 201.053, [201.057,] 201.058, and 202.060, Tax Code, do not affect
1616 the fee imposed by this section.
1717 SECTION 2. Section 201.057, Tax Code, is repealed.
1818 SECTION 3. (a) Subject to Subsection (b) of this section,
1919 the change in law made by this Act does not affect tax liability
2020 accruing before the effective date of this Act. That liability
2121 continues in effect as if this Act had not been enacted, and the
2222 former law is continued in effect for the collection of taxes due
2323 and for civil and criminal enforcement of the liability for those
2424 taxes.
2525 (b) The tax reduction provided by Section 201.057, Tax Code,
2626 as repealed by this Act, does not apply to gas produced on or after
2727 the effective date of this Act, regardless of whether the
2828 comptroller approved a tax reduction under Section 201.057 that
2929 would have applied to the gas on or after the effective date of this
3030 Act had Section 201.057 not been repealed.
3131 SECTION 4. This Act takes effect September 1, 2025.
