| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subtitle H, Title 2, Health and Safety Code, is |

| 13 | 13 | | amended by adding Chapter 171A to read as follows: |

| 14 | 14 | | CHAPTER 171A. PROHIBITED REPORT OR DISCLOSURE OF CERTAIN HEALTH |

| 16 | 16 | | Sec. 171A.001. PROHIBITED REPORT OR DISCLOSURE BY |
|---|
| 17 | 17 | | PHYSICIANS AND OTHER HEALTH CARE PROVIDERS. Notwithstanding any |
|---|
| 18 | 18 | | other law, a physician or other health care provider who provides |
|---|
| 19 | 19 | | health care services to a patient who experienced a miscarriage or |
|---|
| 20 | 20 | | obtained an abortion or who the physician or provider suspects may |
|---|
| 21 | 21 | | have experienced a miscarriage or obtained an abortion is |
|---|
| 22 | 22 | | prohibited from reporting or disclosing that information to a peace |
|---|
| 23 | 23 | | officer or law enforcement agency. |

| 24 | 24 | | Sec. 171A.002. ENFORCEMENT. A physician's or other health |
|---|
| 25 | 25 | | care provider's report or disclosure of information prohibited |
|---|
| 26 | 26 | | under Section 171A.001 constitutes a violation of Chapter 181 and |
|---|
| 27 | 27 | | the physician or provider is subject to enforcement actions under |
|---|
| 28 | 28 | | Subchapter E of that chapter, including disciplinary action by the |
|---|
| 29 | 29 | | appropriate licensing authority. |
|---|
| 30 | 30 | | Sec. 171A.003. RULES. The executive commissioner may adopt |
|---|
| 31 | 31 | | rules to implement this chapter. |
|---|
| 32 | 32 | | SECTION 2. Chapter 171A, Health and Safety Code, as added by |
|---|
| 33 | 33 | | this Act, applies only to the report or disclosure of information |
|---|
| 34 | 34 | | described by that chapter that occurs on or after the effective date |
|---|
| 35 | 35 | | of this Act. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2025. |
