88 AN ACT
99 relating to the prohibited report or disclosure of certain health
1010 information by physicians and other health care providers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle H, Title 2, Health and Safety Code, is
1313 amended by adding Chapter 171A to read as follows:
1414 CHAPTER 171A. PROHIBITED REPORT OR DISCLOSURE OF CERTAIN HEALTH
1515 INFORMATION
1616 Sec. 171A.001. PROHIBITED REPORT OR DISCLOSURE BY
1717 PHYSICIANS AND OTHER HEALTH CARE PROVIDERS. Notwithstanding any
1818 other law, a physician or other health care provider who provides
1919 health care services to a patient who experienced a miscarriage or
2020 obtained an abortion or who the physician or provider suspects may
2121 have experienced a miscarriage or obtained an abortion is
2222 prohibited from reporting or disclosing that information to a peace
2323 officer or law enforcement agency.
2424 Sec. 171A.002. ENFORCEMENT. A physician's or other health
2525 care provider's report or disclosure of information prohibited
2626 under Section 171A.001 constitutes a violation of Chapter 181 and
2727 the physician or provider is subject to enforcement actions under
2828 Subchapter E of that chapter, including disciplinary action by the
2929 appropriate licensing authority.
3030 Sec. 171A.003. RULES. The executive commissioner may adopt
3131 rules to implement this chapter.
3232 SECTION 2. Chapter 171A, Health and Safety Code, as added by
3333 this Act, applies only to the report or disclosure of information
3434 described by that chapter that occurs on or after the effective date
3535 of this Act.
3636 SECTION 3. This Act takes effect September 1, 2025.
