11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 234, Local Government | |
13 | 13 | Code, is amended by adding Section 234.0025 to read as follows: | |
14 | 14 | Sec. 234.0025. REGULATION OF RECYCLING BUSINESSES. (a) | |
15 | 15 | This section applies only to a county: | |
16 | 16 | (1) in which a municipality with a population of | |
17 | 17 | 500,000 or more is located; and | |
18 | 18 | (2) that is located on an international border. | |
19 | 19 | (b) The commissioners court of a county to which this | |
20 | 20 | section applies by order may regulate the operation of a recycling | |
21 | 21 | business located in the unincorporated area of the county. | |
22 | 22 | (c) A commissioners court may not include in an order | |
23 | 23 | adopted under this section a requirement that conflicts with a | |
24 | 24 | similar requirement prescribed by another law governing a recycling | |
25 | 25 | business, including a requirement prescribed by Chapter 396, | |
26 | 26 | Transportation Code. | |
27 | 27 | SECTION 2. This Act takes effect immediately if it receives | |
28 | 28 | a vote of two-thirds of all the members elected to each house, as | |
29 | 29 | provided by Section 39, Article III, Texas Constitution. If this | |
30 | 30 | Act does not receive the vote necessary for immediate effect, this | |
31 | 31 | Act takes effect September 1, 2025. |
