88 AN ACT
99 relating to the authority of certain counties to regulate recycling
1010 businesses.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 234, Local Government
1313 Code, is amended by adding Section 234.0025 to read as follows:
1414 Sec. 234.0025. REGULATION OF RECYCLING BUSINESSES. (a)
1515 This section applies only to a county:
1616 (1) in which a municipality with a population of
1717 500,000 or more is located; and
1818 (2) that is located on an international border.
1919 (b) The commissioners court of a county to which this
2020 section applies by order may regulate the operation of a recycling
2121 business located in the unincorporated area of the county.
2222 (c) A commissioners court may not include in an order
2323 adopted under this section a requirement that conflicts with a
2424 similar requirement prescribed by another law governing a recycling
2525 business, including a requirement prescribed by Chapter 396,
2626 Transportation Code.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2025.
