| 42 | 33 | | (5) a person conducting a real estate transaction |
|---|
| 43 | 34 | | under a court order or the authority of a will or written trust |

| 44 | 35 | | instrument; |

| 45 | 36 | | (6) a person employed by an owner in the sale of |

| 46 | 37 | | structures and land on which structures are located if the |
|---|
| 47 | 38 | | structures are erected by the owner in the course of the owner's |

| 49 | 40 | | (7) an on-site manager of an apartment complex; |

| 50 | 41 | | (8) an owner or the owner's employee who leases the |

| 51 | 42 | | owner's improved or unimproved real estate; [or] |

| 52 | 43 | | (9) a transaction involving: |

| 53 | 44 | | (A) the sale, lease, or transfer of a real |

| 54 | 45 | | property interest in: |

| 55 | 46 | | (i) minerals, mining, or a quarry; |

| 56 | 47 | | (ii) standing timber; or |
|---|
| 57 | 48 | | (iii) other energy sources [mineral or |
|---|
| 58 | 49 | | mining interest in real property]; |

| 59 | 50 | | (B) the sale, lease, or transfer of a cemetery |

| 60 | 51 | | lot; |
|---|
| 61 | 52 | | (C) the lease or management of a hotel or motel; |

| 62 | 53 | | or |
|---|
| 63 | 54 | | (D) the sale of real property under a power of |
|---|
| 64 | 55 | | sale conferred by a deed of trust or other contract lien; |

| 65 | 56 | | (10) the sale, lease, or transfer of real estate owned |

| 66 | 57 | | or leased by or being acquired by or leased to a limited partnership |

| 85 | 76 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 86 | 77 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 87 | 78 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 88 | 79 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 89 | 80 | | Act takes effect September 1, 2025. |
