7	14		AN ACT
8	15		relating to fire safety inspections at public and private schools.
9	16		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	17		SECTION 1. Section 419.029, Government Code, is amended to
11	18		read as follows:
12	19		Sec. 419.029. TRAINING CURRICULUM. (a) The commission may
13	20		establish minimum curriculum requirements for preparatory,
14	21		in-service, and advanced courses and programs for a school operated
15	22		by or for this state or a local government specifically for training
16	23		fire protection personnel or recruits.
17	24		(b) The minimum curriculum requirements established by the
18	25		commission under Subsection (a) must require training on conducting
19	26		a fire safety inspection at a public or private school in accordance
20	27		with Section 419.909.
21	28		SECTION 2. Section 419.909, Government Code, is amended by
22	29		adding Subsections (b-1), (b-2), and (b-3) to read as follows:
23	30		(b-1) A fire safety inspection of a public or private
24	31		school, including an open-enrollment charter school, required by a
25	32		state or local law, rule, regulation, or ordinance must include an
26	33		examination of each automated external defibrillator, as defined by
27	34		Section 779.001, Health and Safety Code, on the school campus to
28	35		determine whether the defibrillator is fully functional, which must
29	36		include verifying that that defibrillator's pads and battery have
30	37		not expired and that the defibrillator's status indicator light
31	38		indicates that the device is ready for use. A representative of the
32	39		school campus shall present each automated external defibrillator
33	40		for inspection.
34	41		(b-2) A person who conducts a fire safety inspection
35	42		described by Subsection (b-1) must:
36	43		(1) provide a written report of the inspection and any
37	44		relevant paperwork pertaining to the findings of the inspection to:
38	45		(A) if the inspection is of a public school, the
39	46		principal of the school and the superintendent of the applicable
40	47		school district; or
41	48		(B) if the inspection is of a private school, the
42	49		director of the school; and
43	50		(2) at the time the person provides the report as
44	51		required by Subdivision (1), indicate on the report the method by
45	52		which, and the time and date on which, the person provided the
46	53		report to the appropriate person under that subdivision.
47	54		(b-3) The report required under Subsection (b-2) must be
48	55		filed:
49	56		(1) at the school campus to which the report relates;
50	57		and
51	58		(2) according to the year in which the inspection
52	59		occurred.
53	60		SECTION 3. This Act takes effect September 1, 2025.
