613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to fire safety inspections at public and private schools.
916 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1017 SECTION 1. Section 419.029, Government Code, is amended to
1118 read as follows:
1219 Sec. 419.029. TRAINING CURRICULUM. (a) The commission may
1320 establish minimum curriculum requirements for preparatory,
1421 in-service, and advanced courses and programs for a school operated
1522 by or for this state or a local government specifically for training
1623 fire protection personnel or recruits.
1724 (b) The minimum curriculum requirements established by the
1825 commission under Subsection (a) must require training on conducting
1926 a fire safety inspection at a public or private school in accordance
2027 with Section 419.909.
2128 SECTION 2. Section 419.909, Government Code, is amended by
2229 adding Subsections (b-1), (b-2), and (b-3) to read as follows:
2330 (b-1) A fire safety inspection of a public or private
2431 school, including an open-enrollment charter school, required by a
2532 state or local law, rule, regulation, or ordinance must include an
2633 examination of each automated external defibrillator, as defined by
2734 Section 779.001, Health and Safety Code, on the school campus to
2835 determine whether the defibrillator is fully functional, which must
2936 include verifying that that defibrillator's pads and battery have
3037 not expired and that the defibrillator's status indicator light
3138 indicates that the device is ready for use. A representative of the
3239 school campus shall present each automated external defibrillator
3340 for inspection.
3441 (b-2) A person who conducts a fire safety inspection
3542 described by Subsection (b-1) must:
3643 (1) provide a written report of the inspection and any
3744 relevant paperwork pertaining to the findings of the inspection to:
3845 (A) if the inspection is of a public school, the
3946 principal of the school and the superintendent of the applicable
4047 school district; or
4148 (B) if the inspection is of a private school, the
4249 director of the school; and
4350 (2) at the time the person provides the report as
4451 required by Subdivision (1), indicate on the report the method by
4552 which, and the time and date on which, the person provided the
4653 report to the appropriate person under that subdivision.
4754 (b-3) The report required under Subsection (b-2) must be
4855 filed:
4956 (1) at the school campus to which the report relates;
5057 and
5158 (2) according to the year in which the inspection
5259 occurred.
5360 SECTION 3. This Act takes effect September 1, 2025.
