77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to standard permits for certain concrete plants.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 382.05195, Health and Safety Code, is
1212 amended by amending Subsection (k) and adding Subsection (l) to
1313 read as follows:
1414 (k) An application for an authorization to use [the issuance
1515 of] a standard permit under this section for a concrete plant that
1616 performs wet batching, dry batching, or central mixing, including a
1717 permanent, temporary, or specialty concrete batch plant, as defined
1818 by the commission, must include:
1919 (1) a statement of the proposed daily hours of
2020 operation for:
2121 (A) the facility; and
2222 (B) vehicles associated with transporting
2323 material to or from the facility; and
2424 (2) a plot plan that clearly shows:
2525 (A) [(1)] a distance scale;
2626 (B) [(2)] a north arrow;
2727 (C) [(3)] all property lines, emission points,
2828 buildings, tanks, and process vessels and other process equipment
2929 in the area in which the facility will be located;
3030 (D) [(4)] at least two benchmark locations in the
3131 area in which the facility will be located; and
3232 (E) [(5)] if the permit requires a distance,
3333 setback, or buffer from other property or structures as a condition
3434 of the permit, whether the required distance or setback will be met.
3535 (l) A standard permit described by Subsection (k):
3636 (1) must require that, unless the executive director
3737 provides otherwise in the authorization to use the standard permit:
3838 (A) the facility operate only after 7:00 a.m. and
3939 before 7:00 p.m.; and
4040 (B) at the facility site, vehicles transport
4141 material used in the production of concrete only after 5:00 a.m. and
4242 before 9:00 p.m.;
4343 (2) may allow the executive director to include in the
4444 authorization to use the standard permit alternative operating
4545 hours for the facility for use during not more than five days per
4646 calendar year to accommodate special circumstances;
4747 (3) must allow the appropriate commission regional
4848 office to authorize temporary alternative operating hours for the
4949 facility in response to a disaster or other emergency; and
5050 (4) must require that records be maintained on site
5151 that show the use of alternative operating hours authorized under
5252 Subdivision (2) or (3).
5353 SECTION 2. Section 382.051985, Health and Safety Code, is
5454 amended by adding Subsection (c) to read as follows:
5555 (c) Section 382.05195(l) does not apply to a plant permitted
5656 under this section.
5757 SECTION 3. This Act takes effect September 1, 2025.
