77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to an unauthorized vote by a delegate or alternate
1010 delegate to a federal Article V convention; creating a criminal
1111 offense.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 393, Government Code, is
1414 amended by adding Section 393.1035 to read as follows:
1515 Sec. 393.1035. CRIMINAL PENALTY. (a) A delegate or
1616 alternate delegate commits an offense if the delegate or alternate
1717 delegate knowingly casts an unauthorized vote.
1818 (b) An offense under this section is a state jail felony.
1919 (c) A judge granting community supervision to a defendant
2020 convicted of an offense under this section shall require as a
2121 condition of community supervision that the defendant submit to not
2222 less than 10 days of confinement in county jail. If a sentence of
2323 confinement is imposed on the revocation of community supervision,
2424 the term of confinement served under this subsection may not be
2525 credited toward completion of the sentence imposed.
2626 SECTION 2. This Act takes effect September 1, 2025.
