| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter D, Chapter 431, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 431.085 to read as follows: |

| 14 | 14 | | Sec. 431.085. REQUIRED NOTICE ON LABEL OF FOOD CONTAINING |
|---|
| 15 | 15 | | MRNA VACCINE MATERIAL. (a) In this section, "mRNA vaccine |
|---|
| 16 | 16 | | material" means a substance included in a vaccine to stimulate the |
|---|
| 17 | 17 | | production of antibodies and provide immunity against disease by |
|---|
| 18 | 18 | | introducing messenger ribonucleic acid (mRNA) that corresponds to a |
|---|
| 19 | 19 | | viral protein. |
|---|
| 20 | 20 | | (b) A person may not sell in this state food injected with an |
|---|
| 21 | 21 | | mRNA vaccine or containing any ingredient derived from food |
|---|
| 22 | 22 | | injected with the vaccine unless the food's label includes a clear |
|---|
| 23 | 23 | | and conspicuous notice stating the food contains mRNA vaccine |
|---|
| 24 | 24 | | material. |

| 25 | 25 | | SECTION 2. Subchapter C, Chapter 433, Health and Safety |
|---|
| 26 | 26 | | Code, is amended by adding Section 433.0416 to read as follows: |

| 27 | 27 | | Sec. 433.0416. LABELING OF MEAT FOOD PRODUCTS CONTAINING |
|---|
| 28 | 28 | | MRNA VACCINE MATERIAL. (a) In this section, "mRNA vaccine |
|---|
| 29 | 29 | | material" means a substance included in a vaccine to stimulate the |
|---|
| 30 | 30 | | production of antibodies and provide immunity against disease by |
|---|
| 31 | 31 | | introducing messenger ribonucleic acid (mRNA) that corresponds to a |
|---|
| 32 | 32 | | viral protein. |
|---|
| 33 | 33 | | (b) A person may not sell in this state a meat food product |
|---|
| 34 | 34 | | derived from livestock injected with an mRNA vaccine unless the |
|---|
| 35 | 35 | | product's label includes a clear and conspicuous notice stating the |
|---|
| 36 | 36 | | product contains mRNA vaccine material. |
|---|
| 37 | 37 | | SECTION 3. As soon as practicable after the effective date |
|---|
| 38 | 38 | | of this Act, the executive commissioner of the Health and Human |
|---|
| 39 | 39 | | Services Commission shall adopt rules necessary to implement the |
|---|
| 40 | 40 | | changes in law made by this Act. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect January 1, 2026. |
