77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a requirement that the ballot for an election to amend
1010 the state constitution include an estimate of the cost to the state
1111 of the proposed amendment.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. The heading to Section 274.001, Election Code,
1414 is amended to read as follows:
1515 Sec. 274.001. FORM OF AMENDMENT ON BALLOT; COST ESTIMATE.
1616 SECTION 2. Section 274.001, Election Code, is amended by
1717 adding Subsection (d) to read as follows:
1818 (d) For each proposition submitting a proposed
1919 constitutional amendment, the secretary of state shall prepare for
2020 placement on the ballot an estimate of the anticipated cost to the
2121 state of the proposed amendment during the state fiscal biennium in
2222 which the proposed amendment takes effect should the proposition be
2323 approved at the election. The secretary of state may request the
2424 assistance of the Legislative Budget Board in preparing the
2525 estimate required by this subsection.
2626 SECTION 3. Section 274.003(a), Election Code, is amended to
2727 read as follows:
2828 (a) For each proposed constitutional amendment, the
2929 secretary of state shall certify in writing for placement on the
3030 ballot:
3131 (1) the wording of the proposition submitting the
3232 amendment; [and]
3333 (2) the cost estimate prepared for the proposition
3434 under Section 274.001(d); and
3535 (3) the proposition's number.
3636 SECTION 4. The secretary of state may adopt rules as
3737 necessary to implement and administer Section 274.001(d), Election
3838 Code, as added by this Act.
3939 SECTION 5. The changes in law made by this Act apply only to
4040 a ballot for an election on a proposed constitutional amendment
4141 ordered on or after the effective date of this Act. An election on a
4242 proposed constitutional amendment ordered before the effective
4343 date of this Act is governed by the law in effect when the election
4444 was ordered, and the former law is continued in effect for that
4545 purpose.
4646 SECTION 6. This Act takes effect September 1, 2025.
