711 A BILL TO BE ENTITLED
812 AN ACT
913 relating to the designation of spaceports as critical
1014 infrastructure facilities for purposes of criminal and civil
1115 liability.
1216 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1317 SECTION 1. Section 424.001, Government Code, is amended to
1418 read as follows:
1519 Sec. 424.001. DEFINITION. In this chapter, "critical
1620 infrastructure facility" has the meaning assigned by Section
1721 423.0045(a)(1-a) and also includes:
1822 (1) any pipeline transporting oil or gas or the
1923 products or constituents of oil or gas;
2024 (2) a public or private airport depicted in any
2125 current aeronautical chart published by the Federal Aviation
2226 Administration;
2327 (3) a military installation owned or operated by or
2428 for the federal government, this state, or another governmental
2529 entity; [and]
2630 (4) any property or facility that is:
2731 (A) used for the launch, landing, recovery, or
2832 testing of spacecraft, as defined by Section 507.001, Local
2933 Government Code; and
3034 (B) licensed by the Federal Aviation
3135 Administration or operated by a spaceport development corporation
3236 under Chapter 507, Local Government Code; and
3337 (5) a property, facility, or pipeline described by
3438 this section that is under construction and all equipment and
3539 appurtenances used during that construction.
3640 SECTION 2. The change in law made by this Act applies only
3741 to an offense committed on or after the effective date of this Act.
3842 An offense committed before the effective date of this Act is
3943 governed by the law in effect on the date the offense was committed,
4044 and the former law is continued in effect for that purpose. For
4145 purposes of this section, an offense was committed before the
4246 effective date of this Act if any element of the offense was
4347 committed before that date.
4448 SECTION 3. The change in law made by this Act applies only
4549 to a cause of action that accrues on or after the effective date of
4650 this Act. A cause of action that accrues before the effective date
4751 of this Act is governed by the law in effect on the date the cause of
4852 action accrued, and the former law is continued in effect for that
4953 purpose.
5054 SECTION 4. This Act takes effect September 1, 2025.
