10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 1016.053, Special District Local Laws |
---|
12 | 12 | | Code, is amended to read as follows: |
---|
13 | 13 | | Sec. 1016.053. BALLOT APPLICATION [PETITION]. A person who |
---|
14 | 14 | | wants to have the person's name printed on the ballot as a candidate |
---|
15 | 15 | | for director must file an application with the board secretary in |
---|
16 | 16 | | accordance with Chapter 144, Election Code [a petition requesting |
---|
17 | 17 | | that action. The petition must be: |
---|
18 | 18 | | [(1) signed by at least 10 registered taxpaying |
---|
19 | 19 | | voters; and |
---|
20 | 20 | | [(2) filed by the deadline imposed by Section 144.005, |
---|
21 | 21 | | Election Code]. |
---|
22 | 22 | | SECTION 2. Section 1016.054, Special District Local Laws |
---|
23 | 23 | | Code, is amended to read as follows: |
---|
24 | 24 | | Sec. 1016.054. QUALIFICATIONS FOR OFFICE. (a) A person may |
---|
25 | 25 | | not be elected or appointed as a director unless the person is: |
---|
26 | 26 | | (1) a district resident; and |
---|
27 | 27 | | (2) a qualified voter[; |
---|
28 | 28 | | [(3) a freeholder; and |
---|
29 | 29 | | [(4) at least 18 years of age when elected or |
---|
30 | 30 | | appointed]. |
---|
31 | 31 | | (b) A person may not be elected or appointed as a director if |
---|
32 | 32 | | the person is a district employee. |
---|
33 | 33 | | SECTION 3. Section 1016.057, Special District Local Laws |
---|
34 | 34 | | Code, is amended to read as follows: |
---|
35 | 35 | | Sec. 1016.057. OFFICERS. The board shall elect a |
---|
36 | 36 | | president, a vice president, and a secretary from among its |
---|
37 | 37 | | members. |
---|
38 | 38 | | SECTION 4. The heading to Section 1016.060, Special |
---|
39 | 39 | | District Local Laws Code, is amended to read as follows: |
---|
40 | 40 | | Sec. 1016.060. DISTRICT ADMINISTRATOR[; ASSISTANT |
---|
41 | 41 | | ADMINISTRATOR]. |
---|
42 | 42 | | SECTION 5. Section 1016.060(c), Special District Local Laws |
---|
43 | 43 | | Code, is amended to read as follows: |

44 | 44 | | (c) The district administrator serves [and any assistant |
---|
45 | 45 | | administrator serve] at the will of the board and is [are] entitled |

46 | 46 | | to the compensation determined by the board. |

47 | 47 | | SECTION 6. Section 1016.110, Special District Local Laws |

48 | 48 | | Code, is amended to read as follows: |

49 | 49 | | Sec. 1016.110. CONSTRUCTION [OR PURCHASE] CONTRACTS. (a) |
---|
50 | 50 | | The board may enter into construction contracts for the district. |
---|
51 | 51 | | (b) The board may enter into a public work contract as |
---|
52 | 52 | | authorized under Chapter 2269, Government Code. |
---|
53 | 53 | | (c) Chapter 2253, Government Code, as it relates to |
---|
54 | 54 | | performance and payment bonds, applies to the district's |
---|
55 | 55 | | construction contracts [A construction or purchase contract that |
---|
56 | 56 | | involves the expenditure of more than $2,000 may be made only after |
---|
57 | 57 | | advertising in the manner provided by Chapter 252 and Subchapter C, |
---|
58 | 58 | | Chapter 262, Local Government Code]. |
---|
59 | 59 | | SECTION 7. Section 1016.160(a), Special District Local Laws |
---|
60 | 60 | | Code, is amended to read as follows: |
---|
61 | 61 | | (a) Except as otherwise provided by Section 1016.107(c) of |
---|
62 | 62 | | this code, Section 315.002, Health and Safety Code, this |
---|
63 | 63 | | subchapter, and Subchapter E of this chapter, the district may not |
---|
64 | 64 | | incur a debt [an obligation] payable from district revenue other |
---|
65 | 65 | | than the revenue on hand or to be on hand in the current and |
---|
66 | 66 | | following district fiscal years. |
---|
67 | 67 | | SECTION 8. The following provisions of the Special District |
---|
68 | 68 | | Local Laws Code are repealed: |
---|
69 | 69 | | (1) Section 1016.055; and |
---|
70 | 70 | | (2) Sections 1016.060(b) and (d). |
---|
71 | 71 | | SECTION 9. (a) The changes in law made by this Act to |
---|
72 | 72 | | Section 1016.053, Special District Local Laws Code, apply only to |
---|
73 | 73 | | an election ordered on or after the effective date of this Act. |
---|
74 | 74 | | (b) The changes in law made by this Act to Section 1016.054, |
---|
75 | 75 | | Special District Local Laws Code: |
---|
76 | 76 | | (1) do not affect the entitlement of a director |
---|
77 | 77 | | serving on the board of directors immediately before the effective |
---|
78 | 78 | | date of this Act to continue to serve on the board for the remainder |
---|
79 | 79 | | of the director's term; |
---|
80 | 80 | | (2) apply only to a member of the board of directors |
---|
81 | 81 | | elected or appointed to the board on or after the effective date of |
---|
82 | 82 | | this Act; and |
---|
83 | 83 | | (3) do not prohibit a director serving on the board of |
---|
84 | 84 | | directors on the effective date of this Act from being reelected or |
---|
85 | 85 | | reappointed to the board if the director has the qualifications |
---|
86 | 86 | | required for membership on the board under Section 1016.054, |
---|
87 | 87 | | Special District Local Laws Code, as amended by this Act. |
---|
88 | 88 | | SECTION 10. This Act takes effect immediately if it |
---|
89 | 89 | | receives a vote of two-thirds of all the members elected to each |
---|
90 | 90 | | house, as provided by Section 39, Article III, Texas Constitution. |
---|
91 | 91 | | If this Act does not receive the vote necessary for immediate |
---|
92 | 92 | | effect, this Act takes effect September 1, 2025. |
