77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to required labeling of certain products containing or
1010 derived from aborted human fetal tissue.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 431, Health and Safety
1313 Code, is amended by adding Section 431.085 to read as follows:
1414 Sec. 431.085. LABELING REQUIRED FOR FETAL TISSUE FOOD
1515 PRODUCT. (a) In this section:
1616 (1) "Fetal tissue food product" means a food or food
1717 additive that:
1818 (A) contains human fetal tissue;
1919 (B) is manufactured using human fetal tissue; or
2020 (C) is otherwise derived from research using
2121 human fetal tissue.
2222 (2) "Human fetal tissue" means tissue, cells,
2323 including cells from fetal cell lines, or organs obtained or
2424 originally derived from an aborted unborn child.
2525 (b) A person may not sell in this state a fetal tissue food
2626 product unless the product is clearly and conspicuously labeled in
2727 accordance with department rules.
2828 (c) The executive commissioner by rule shall prescribe the
2929 form and contents of the label required by Subsection (b).
3030 SECTION 2. Subchapter E, Chapter 431, Health and Safety
3131 Code, is amended by adding Section 431.118 to read as follows:
3232 Sec. 431.118. LABELING REQUIRED FOR FETAL TISSUE MEDICAL
3333 PRODUCT. (a) In this section:
3434 (1) "Fetal tissue medical product" means a medication,
3535 vaccine, or other medical product used in medical treatment that:
3636 (A) contains human fetal tissue;
3737 (B) is manufactured using human fetal tissue; or
3838 (C) is otherwise derived from research using
3939 human fetal tissue.
4040 (2) "Human fetal tissue" means tissue, cells,
4141 including cells from fetal cell lines, or organs obtained or
4242 originally derived from an aborted unborn child.
4343 (b) A person may not sell, dispense, or administer in this
4444 state a fetal tissue medical product unless the product is clearly
4545 and conspicuously labeled in accordance with department rules.
4646 (c) The executive commissioner by rule shall prescribe the
4747 form and contents of the label required by Subsection (b).
4848 SECTION 3. Subchapter F, Chapter 431, Health and Safety
4949 Code, is amended by adding Section 431.143 to read as follows:
5050 Sec. 431.143. LABELING REQUIRED FOR FETAL TISSUE COSMETIC
5151 PRODUCT. (a) In this section:
5252 (1) "Fetal tissue cosmetic product" means a cosmetic
5353 product that:
5454 (A) contains human fetal tissue;
5555 (B) is manufactured using human fetal tissue; or
5656 (C) is otherwise derived from research using
5757 human fetal tissue.
5858 (2) "Human fetal tissue" means tissue, cells,
5959 including cells from fetal cell lines, or organs obtained or
6060 originally derived from an aborted unborn child.
6161 (b) A person may not sell in this state a fetal tissue
6262 cosmetic product unless the product is clearly and conspicuously
6363 labeled in accordance with department rules.
6464 (c) The executive commissioner by rule shall prescribe the
6565 form and contents of the label required by Subsection (b).
6666 SECTION 4. (a) Not later than December 1, 2025, the
6767 executive commissioner of the Health and Human Services Commission
6868 shall adopt the form and content of the labels required under
6969 Sections 431.085, 431.118, and 431.143, Health and Safety Code, as
7070 added by this Act.
7171 (b) Sections 431.085, 431.118, and 431.143, Health and
7272 Safety Code, as added by this Act, apply only to a fetal tissue
7373 product sold, dispensed, or administered on or after January 1,
7474 2026.
7575 SECTION 5. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2025.
