69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the subject matter jurisdiction of the criminal trial
912 courts of this state.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Subchapter A, Chapter 23, Government Code, is
1215 amended by adding Section 23.002 to read as follows:
1316 Sec. 23.002. SUBJECT MATTER JURISDICTION OF CRIMINAL TRIAL
1417 COURTS NOT CONDITIONED ON EXHAUSTION OF CIVIL REMEDIES. Unless
1518 expressly provided otherwise, the exhaustion of civil, including
1619 administrative, remedies is not a prerequisite to the vesting in a
1720 trial court of subject matter jurisdiction over a criminal action
1821 for which the trial court would otherwise have jurisdiction under
1922 other law.
2023 SECTION 2. This Act applies to a criminal action commenced
2124 before, on, or after the effective date of this Act.
2225 SECTION 3. This Act takes effect immediately if it receives
2326 a vote of two-thirds of all the members elected to each house, as
2427 provided by Section 39, Article III, Texas Constitution. If this
2528 Act does not receive the vote necessary for immediate effect, this
2629 Act takes effect September 1, 2025.
