77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the composition and duties of a court security
1010 committee.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 74.092(a), Government Code, is amended
1313 to read as follows:
1414 (a) A local administrative judge, for the courts for which
1515 the judge serves as local administrative judge, shall:
1616 (1) implement and execute the local rules of
1717 administration, including the assignment, docketing, transfer, and
1818 hearing of cases;
1919 (2) appoint any special or standing committees
2020 necessary or desirable for court management and administration;
2121 (3) promulgate local rules of administration if the
2222 other judges do not act by a majority vote;
2323 (4) recommend to the regional presiding judge any
2424 needs for assignment from outside the county to dispose of court
2525 caseloads;
2626 (5) supervise the expeditious movement of court
2727 caseloads, subject to local, regional, and state rules of
2828 administration;
2929 (6) provide the supreme court and the office of court
3030 administration requested statistical and management information;
3131 (7) set the hours and places for holding court in the
3232 county;
3333 (8) supervise the employment and performance of
3434 nonjudicial personnel;
3535 (9) supervise the budget and fiscal matters of the
3636 local courts, subject to local rules of administration;
3737 (10) coordinate and cooperate with any other local
3838 administrative judge in the district in the assignment of cases in
3939 the courts' concurrent jurisdiction for the efficient operation of
4040 the court system and the effective administration of justice;
4141 (11) if requested by the courts the judge serves,
4242 establish and maintain the lists required by Section 37.003 and
4343 ensure appointments are made from the lists in accordance with
4444 Section 37.004;
4545 (12) perform other duties as may be directed by the
4646 chief justice or a regional presiding judge; and
4747 (13) establish a court security committee to adopt
4848 security policies and procedures for the courts served by the local
4949 administrative district judge that is composed of:
5050 (A) the local administrative district judge, or
5151 the judge's designee, who serves as presiding officer of the
5252 committee;
5353 (B) a representative of the sheriff's office;
5454 (C) a representative of each constable's office
5555 in the county;
5656 (D) a representative of the county commissioners
5757 court;
5858 (E) [(D)] one judge of each type of court in the
5959 county other than a municipal court or a municipal court of record;
6060 (F) a justice of the peace who serves the county;
6161 (G) [(E)] a representative of any county
6262 attorney's office, district attorney's office, or criminal district
6363 attorney's office that serves in the applicable courts; and
6464 (H) [(F)] any other person the committee
6565 determines necessary to assist the committee.
6666 SECTION 2. Section 74.092(b), Government Code, is
6767 redesignated as Section 74.0922, Government Code, and amended to
6868 read as follows:
6969 Sec. 74.0922. DUTIES OF COURT SECURITY COMMITTEE. [(b)] A
7070 court security committee established under Section 74.092(a)(13)
7171 shall meet at least once annually to develop and submit
7272 recommendations [may recommend] to the county commissioners court
7373 on the uses of resources and expenditures of money for courthouse
7474 security, including recommendations on the allocation of any county
7575 court security budget, but may not direct the assignment of those
7676 resources or the expenditure of those funds.
7777 SECTION 3. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2025.
