7	11		AN ACT
8	12		relating to the disclosure of certain harvest report information
9	13		submitted to the Parks and Wildlife Department.
10	14		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	15		SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife
12	16		Code, is amended by adding Section 11.0305 to read as follows:
13	17		Sec. 11.0305. DISCLOSURE OF HARVEST REPORT INFORMATION.
14	18		(a) Information from a report submitted to the department relating
15	19		to the recreational harvest authorized by Chapter 42, 46, 50, or 71
16	20		of game animals, game birds, fur-bearing animals, nongame animals,
17	21		alligators, or fish or other aquatic life, including the specific
18	22		location of harvested wildlife, may not be disclosed except as
19	23		authorized by this section or Section 12.014.
20	24		(b) Chapter 552, Government Code, does not apply to
21	25		information from a report described by Subsection (a).
22	26		(c) The commission or the department may disclose
23	27		information from a report described by Subsection (a) to a federal
24	28		or state law enforcement agency if the agency provides a lawfully
25	29		issued subpoena.
26	30		(d) The department may disclose statistical data and
27	31		compilations of information from a report described by Subsection
28	32		(a) in a manner that does not identify:
29	33		(1) any person who:
30	34		(A) submitted the report; or
31	35		(B) harvested wildlife as described in the
32	36		report; or
33	37		(2) any specific location information, including a
34	38		photograph, that could be used to identify the location where the
35	39		harvest of wildlife described in the report occurred.
36	40		(e) The department may disclose information from a report
37	41		described by Subsection (a) only to:
38	42		(1) an individual identified in the report or that
39	43		individual's representative;
40	44		(2) another governmental body, including a law
41	45		enforcement entity, as needed to carry out a governmental purpose;
42	46		or
43	47		(3) an entity contracted with the department that has
44	48		signed a nondisclosure agreement prohibiting the entity from
45	49		disclosing information from the report, if necessary for research,
46	50		analysis, or another activity the department determines to be
47	51		appropriate.
48	52		(f) This section does not authorize the department to
49	53		disclose information the department is prohibited from disclosing
50	54		by other law.
51	55		(g) The department and its officers and employees are immune
52	56		from civil liability for an unintentional violation of this
53	57		section.
54	58		(h) In this section, a reference to the department includes
55	59		a reference to an agent of the department.
56	60		SECTION 2. The change in law made by this Act applies to a
57	61		disclosure by the Parks and Wildlife Department of information in a
58	62		report described by Section 11.0305(a), Parks and Wildlife Code, as
59	63		added by this Act, that is made on or after the effective date of
60	64		this Act, regardless of when the report containing the information
61	65		was submitted to the department.
62	66		SECTION 3. This Act takes effect September 1, 2025.
