610 A BILL TO BE ENTITLED
711 AN ACT
812 relating to the disclosure of certain harvest report information
913 submitted to the Parks and Wildlife Department.
1014 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1115 SECTION 1. Subchapter B, Chapter 11, Parks and Wildlife
1216 Code, is amended by adding Section 11.0305 to read as follows:
1317 Sec. 11.0305. DISCLOSURE OF HARVEST REPORT INFORMATION.
1418 (a) Information from a report submitted to the department relating
1519 to the recreational harvest authorized by Chapter 42, 46, 50, or 71
1620 of game animals, game birds, fur-bearing animals, nongame animals,
1721 alligators, or fish or other aquatic life, including the specific
1822 location of harvested wildlife, may not be disclosed except as
1923 authorized by this section or Section 12.014.
2024 (b) Chapter 552, Government Code, does not apply to
2125 information from a report described by Subsection (a).
2226 (c) The commission or the department may disclose
2327 information from a report described by Subsection (a) to a federal
2428 or state law enforcement agency if the agency provides a lawfully
2529 issued subpoena.
2630 (d) The department may disclose statistical data and
2731 compilations of information from a report described by Subsection
2832 (a) in a manner that does not identify:
2933 (1) any person who:
3034 (A) submitted the report; or
3135 (B) harvested wildlife as described in the
3236 report; or
3337 (2) any specific location information, including a
3438 photograph, that could be used to identify the location where the
3539 harvest of wildlife described in the report occurred.
3640 (e) The department may disclose information from a report
3741 described by Subsection (a) only to:
3842 (1) an individual identified in the report or that
3943 individual's representative;
4044 (2) another governmental body, including a law
4145 enforcement entity, as needed to carry out a governmental purpose;
4246 or
4347 (3) an entity contracted with the department that has
4448 signed a nondisclosure agreement prohibiting the entity from
4549 disclosing information from the report, if necessary for research,
4650 analysis, or another activity the department determines to be
4751 appropriate.
4852 (f) This section does not authorize the department to
4953 disclose information the department is prohibited from disclosing
5054 by other law.
5155 (g) The department and its officers and employees are immune
5256 from civil liability for an unintentional violation of this
5357 section.
5458 (h) In this section, a reference to the department includes
5559 a reference to an agent of the department.
5660 SECTION 2. The change in law made by this Act applies to a
5761 disclosure by the Parks and Wildlife Department of information in a
5862 report described by Section 11.0305(a), Parks and Wildlife Code, as
5963 added by this Act, that is made on or after the effective date of
6064 this Act, regardless of when the report containing the information
6165 was submitted to the department.
6266 SECTION 3. This Act takes effect September 1, 2025.
