611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the regulation of land surveyors by the Texas Board of
914 Professional Engineers and Land Surveyors.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 1001.216, Occupations Code, is amended
1217 by adding Subsections (a-1) and (a-2) to read as follows:
1318 (a-1) The advisory committee appointed under Subsection (a)
1419 may, on its own initiative or at the request of any interested
1520 person, prepare a written report or recommendation to the board on
1621 any surveying-related subject regulated by the board.
1722 (a-2) The advisory committee appointed under Subsection (a)
1823 shall maintain a written public record of each subject discussed
1924 and action taken at the committee's meetings.
2025 SECTION 2. Section 1001.601(a), Occupations Code, is
2126 amended to read as follows:
2227 (a) On its own initiative or at the request of any
2328 interested person, the board shall prepare a written advisory
2429 opinion about:
2530 (1) an interpretation of this chapter or Chapter 1071;
2631 or
2732 (2) the application of this chapter or Chapter 1071 to
2833 a person in regard to a specified existing or hypothetical factual
2934 situation.
3035 SECTION 3. Sections 1071.253(a) and (c), Occupations Code,
3136 are amended to read as follows:
3237 (a) An applicant for a surveyor-in-training certificate
3338 must:
3439 (1) have earned a bachelor of science degree in
3540 surveying from an accredited institution of higher education;
3641 (2) have:
3742 (A) earned a bachelor's degree from an accredited
3843 institution of higher education that included at least 32 semester
3944 hours in a combination of courses acceptable to the board in:
4045 (i) land surveying [civil engineering];
4146 (ii) civil engineering [land surveying];
4247 (iii) mathematics;
4348 (iv) photogrammetry;
4449 (v) forestry;
4550 (vi) land law; or
4651 (vii) the physical sciences; and
4752 (B) completed at least one year of experience
4853 acceptable to the board in delegated responsible charge as a
4954 subordinate to a registered professional land surveyor actively
5055 engaged in professional surveying;
5156 (3) have:
5257 (A) earned an associate degree in surveying from
5358 an accredited institution of higher education; and
5459 (B) completed at least two years of experience
5560 acceptable to the board in delegated responsible charge as a
5661 subordinate to a registered professional land surveyor actively
5762 engaged in professional surveying;
5863 (4) have:
5964 (A) successfully completed a course of
6065 instruction consisting of 32 semester hours in land surveying or
6166 the equivalent number of semester hours in board-approved courses
6267 related to surveying; and
6368 (B) completed at least two years of experience
6469 acceptable to the board in delegated responsible charge as a
6570 subordinate to a registered professional land surveyor actively
6671 engaged in professional surveying; or
6772 (5) have:
6873 (A) graduated from an accredited high school;
6974 (B) completed at least four years of experience
7075 acceptable to the board in delegated responsible charge as a
7176 subordinate to a registered professional land surveyor actively
7277 engaged in professional surveying; and
7378 (C) provided evidence satisfactory to the board
7479 that the applicant is self-educated in professional surveying.
7580 (c) On proof that an applicant meets the qualifications
7681 prescribed by Subsection (a) and has passed the fundamentals of
7782 surveying examination prescribed by the board under Section
7883 1071.256, the [The] board shall issue a surveyor-in-training
7984 certificate to the [an] applicant [who passes the applicable parts
8085 of the examination taken under Subsection (b)]. The certificate is
8186 valid for eight years.
8287 SECTION 4. Sections 1071.254(a) and (b), Occupations Code,
8388 are amended to read as follows:
8489 (a) An applicant for registration as a registered
8590 professional land surveyor must:
8691 (1) hold a certificate as a surveyor-in-training;
8792 (2) have passed the principles and practice of
8893 surveying examination prescribed by the board under Section
8994 1071.256;
9095 (3) [(2)] have at least two years of experience
9196 satisfactory to the board as a surveyor-in-training in performing
9297 surveying in delegated responsible charge as a subordinate to a
9398 surveyor registered or licensed to engage in the practice of
9499 surveying in this state or in another state having registration or
95100 licensing requirements equivalent to the requirements of this
96101 state; and
97102 (4) [(3)] have earned an associate or bachelor's
98103 degree from an accredited institution of higher education that
99104 included at least 32 semester hours in a combination of courses
100105 acceptable to the board in:
101106 (A) land surveying [civil engineering];
102107 (B) civil engineering [land surveying];
103108 (C) mathematics;
104109 (D) photogrammetry;
105110 (E) forestry;
106111 (F) land law; or
107112 (G) the physical sciences.
108113 (b) An applicant is entitled to registration as a registered
109114 professional land surveyor if the applicant meets the
110115 qualifications prescribed by Subsection (a) and is approved to take
111116 and passes the required sections of the Texas specific surveying
112117 examination prescribed under Section 1071.256.
113118 SECTION 5. Section 1071.256, Occupations Code, is amended
114119 by adding Subsections (a-1) and (b-1) and amending Subsection (b)
115120 to read as follows:
116121 (a-1) The board by rule shall prescribe the fundamentals of
117122 surveying examination required for an applicant for certification
118123 as a surveyor-in-training under Section 1071.253.
119124 (b) The board by rule shall prescribe the principles and
120125 practice of surveying examination required for an applicant for
121126 registration as a registered professional land surveyor under
122127 Section 1071.254 [must be developed and given as provided by this
123128 chapter under board rules designed] to determine the knowledge and
124129 ability of the applicant.
125130 (b-1) The board by rule shall prescribe the Texas specific
126131 surveying examination required for an applicant for registration as
127132 a registered professional land surveyor under Section 1071.254.
128133 SECTION 6. Section 1071.253(b), Occupations Code, is
129134 repealed.
130135 SECTION 7. As soon as practicable after the effective date
131136 of this Act, the Texas Board of Professional Engineers and Land
132137 Surveyors shall adopt the rules necessary to implement the changes
133138 in law made by this Act.
134139 SECTION 8. Sections 1071.253 and 1071.254, Occupations
135140 Code, as amended by this Act, apply only to an application for,
136141 respectively, a surveyor-in-training certificate or registration
137142 as a registered professional land surveyor filed with the Texas
138143 Board of Professional Engineers and Land Surveyors on or after the
139144 effective date of this Act. An application filed before the
140145 effective date of this Act is governed by the law in effect on the
141146 date the application was filed, and the former law is continued in
142147 effect for that purpose.
143148 SECTION 9. This Act takes effect September 1, 2025.
