11 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 16 | | SECTION 1. Section 16.051, Water Code, is amended by |
---|
13 | 17 | | amending Subsection (d) and adding Subsection (d-1) to read as |
---|
14 | 18 | | follows: |
---|
15 | 19 | | (d) The board, in coordination with the commission, the |
---|
16 | 20 | | Department of Agriculture, and the Parks and Wildlife Department, |
---|
17 | 21 | | shall adopt by rule guidance principles for the state water plan |
---|
18 | 22 | | which reflect the public interest of the entire state. When |
---|
19 | 23 | | adopting guidance principles, due consideration shall be given to |
---|
20 | 24 | | the construction and improvement of surface water resources and the |
---|
21 | 25 | | application of principles that result in voluntary redistribution |
---|
22 | 26 | | of water resources. The board shall review and update the guidance |
---|
23 | 27 | | principles and any other rules related to the state water plan, with |
---|
24 | 28 | | input from the commission, the Department of Agriculture, and the |
---|
25 | 29 | | Parks and Wildlife Department, as necessary but at least every five |
---|
26 | 30 | | years to coincide with the five-year cycle for adoption of a new |
---|
27 | 31 | | water plan as described in Subsection (a). |
---|
28 | 32 | | (d-1) The requirement to review a rule not later than the |
---|
29 | 33 | | fourth anniversary of the date on which the rule takes effect and |
---|
30 | 34 | | every four years after that date under Section 2001.039(b), |
---|
31 | 35 | | Government Code, does not apply to a rule related to the state water |
---|
32 | 36 | | plan adopted under this section. |

33 | 37 | | SECTION 2. Section 16.053, Water Code, is amended by adding |
---|
34 | 38 | | Subsections (f-1) and (f-2) to read as follows: |
---|
35 | 39 | | (f-1) The board shall review and update rules adopted under |
---|
36 | 40 | | this section as necessary but at least every five years to coincide |
---|
37 | 41 | | with the five-year cycle for adoption of a new water plan as |
---|
38 | 42 | | described in Section 16.051. |
---|
39 | 43 | | (f-2) The requirement to review a rule not later than the |
---|
40 | 44 | | fourth anniversary of the date on which the rule takes effect and |
---|
41 | 45 | | every four years after that date under Section 2001.039(b), |
---|
42 | 46 | | Government Code, does not apply to a rule adopted under this |
---|
43 | 47 | | section. |

44 | 48 | | SECTION 3. Section 16.061, Water Code, is amended by |
---|
45 | 49 | | amending Subsection (c) and adding Subsection (c-1) to read as |
---|
46 | 50 | | follows: |
---|
47 | 51 | | (c) The board, in coordination with the commission, the |
---|
48 | 52 | | Department of Agriculture, the General Land Office, the Parks and |
---|
49 | 53 | | Wildlife Department, the Texas Division of Emergency Management, |
---|
50 | 54 | | and the State Soil and Water Conservation Board, shall adopt |
---|
51 | 55 | | guidance principles for the state flood plan that reflect the |
---|
52 | 56 | | public interest of the entire state. The board shall review and |
---|
53 | 57 | | revise the guidance principles and any other rules related to the |
---|
54 | 58 | | state flood plan, with input from the commission, the Department of |
---|
55 | 59 | | Agriculture, the General Land Office, the Parks and Wildlife |
---|
56 | 60 | | Department, the Texas Division of Emergency Management, and the |
---|
57 | 61 | | State Soil and Water Conservation Board, as necessary and at least |
---|
58 | 62 | | every fifth year to coincide with the five-year cycle for adoption |
---|
59 | 63 | | of a new state flood plan. |
---|
60 | 64 | | (c-1) The requirement to review a rule not later than the |
---|
61 | 65 | | fourth anniversary of the date on which the rule takes effect and |
---|
62 | 66 | | every four years after that date under Section 2001.039(b), |
---|
63 | 67 | | Government Code, does not apply to a rule adopted under this |
---|
64 | 68 | | section. |
---|
65 | 69 | | SECTION 4. Section 16.062, Water Code, is amended by adding |
---|
66 | 70 | | Subsections (m) and (n) to read as follows: |
---|
67 | 71 | | (m) The board shall review and update rules adopted under |
---|
68 | 72 | | this section as necessary but at least every five years to coincide |
---|
69 | 73 | | with the five-year cycle for adoption of a new flood plan as |
---|
70 | 74 | | described in Section 16.061. |
---|
71 | 75 | | (n) The requirement to review a rule not later than the |
---|
72 | 76 | | fourth anniversary of the date on which the rule takes effect and |
---|
73 | 77 | | every four years after that date under Section 2001.039(b), |
---|
74 | 78 | | Government Code, does not apply to a rule adopted under this |
---|
75 | 79 | | section. |
---|
76 | 80 | | SECTION 5. This Act takes effect September 1, 2025. |
---|
