610 A BILL TO BE ENTITLED
711 AN ACT
812 relating to the review and updating by the Texas Water Development
913 Board of guidance principles and rules related to certain plans
1014 adopted or approved by the board.
1115 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1216 SECTION 1. Section 16.051, Water Code, is amended by
1317 amending Subsection (d) and adding Subsection (d-1) to read as
1418 follows:
1519 (d) The board, in coordination with the commission, the
1620 Department of Agriculture, and the Parks and Wildlife Department,
1721 shall adopt by rule guidance principles for the state water plan
1822 which reflect the public interest of the entire state. When
1923 adopting guidance principles, due consideration shall be given to
2024 the construction and improvement of surface water resources and the
2125 application of principles that result in voluntary redistribution
2226 of water resources. The board shall review and update the guidance
2327 principles and any other rules related to the state water plan, with
2428 input from the commission, the Department of Agriculture, and the
2529 Parks and Wildlife Department, as necessary but at least every five
2630 years to coincide with the five-year cycle for adoption of a new
2731 water plan as described in Subsection (a).
2832 (d-1) The requirement to review a rule not later than the
2933 fourth anniversary of the date on which the rule takes effect and
3034 every four years after that date under Section 2001.039(b),
3135 Government Code, does not apply to a rule related to the state water
3236 plan adopted under this section.
3337 SECTION 2. Section 16.053, Water Code, is amended by adding
3438 Subsections (f-1) and (f-2) to read as follows:
3539 (f-1) The board shall review and update rules adopted under
3640 this section as necessary but at least every five years to coincide
3741 with the five-year cycle for adoption of a new water plan as
3842 described in Section 16.051.
3943 (f-2) The requirement to review a rule not later than the
4044 fourth anniversary of the date on which the rule takes effect and
4145 every four years after that date under Section 2001.039(b),
4246 Government Code, does not apply to a rule adopted under this
4347 section.
4448 SECTION 3. Section 16.061, Water Code, is amended by
4549 amending Subsection (c) and adding Subsection (c-1) to read as
4650 follows:
4751 (c) The board, in coordination with the commission, the
4852 Department of Agriculture, the General Land Office, the Parks and
4953 Wildlife Department, the Texas Division of Emergency Management,
5054 and the State Soil and Water Conservation Board, shall adopt
5155 guidance principles for the state flood plan that reflect the
5256 public interest of the entire state. The board shall review and
5357 revise the guidance principles and any other rules related to the
5458 state flood plan, with input from the commission, the Department of
5559 Agriculture, the General Land Office, the Parks and Wildlife
5660 Department, the Texas Division of Emergency Management, and the
5761 State Soil and Water Conservation Board, as necessary and at least
5862 every fifth year to coincide with the five-year cycle for adoption
5963 of a new state flood plan.
6064 (c-1) The requirement to review a rule not later than the
6165 fourth anniversary of the date on which the rule takes effect and
6266 every four years after that date under Section 2001.039(b),
6367 Government Code, does not apply to a rule adopted under this
6468 section.
6569 SECTION 4. Section 16.062, Water Code, is amended by adding
6670 Subsections (m) and (n) to read as follows:
6771 (m) The board shall review and update rules adopted under
6872 this section as necessary but at least every five years to coincide
6973 with the five-year cycle for adoption of a new flood plan as
7074 described in Section 16.061.
7175 (n) The requirement to review a rule not later than the
7276 fourth anniversary of the date on which the rule takes effect and
7377 every four years after that date under Section 2001.039(b),
7478 Government Code, does not apply to a rule adopted under this
7579 section.
7680 SECTION 5. This Act takes effect September 1, 2025.
