77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the availability of dates of birth under the public
1010 information law.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 552, Government Code, is
1313 amended by adding Section 552.0223 to read as follows:
1414 Sec. 552.0223. DATES OF BIRTH. Notwithstanding Section
1515 552.101, this chapter does not authorize a governmental body to
1616 withhold a date of birth except as:
1717 (1) permitted by Section 552.102;
1818 (2) permitted by the federal privacy requirements
1919 adopted under the Health Insurance Portability and Accountability
2020 Act of 1996 (Pub. L. No. 104-191) contained in 45 C.F.R. Part 160
2121 and 45 C.F.R. Part 164; or
2222 (3) otherwise provided by constitutional or statutory
2323 law.
2424 SECTION 2. The changes in law made by this Act apply only to
2525 a request for information that is received by a governmental body or
2626 an officer for public information on or after the effective date of
2727 this Act. A request for information that was received before the
2828 effective date of this Act is governed by the law in effect on the
2929 date the request was received, and the former law is continued in
3030 effect for that purpose.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
