| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 552, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 552.0223 to read as follows: |
|---|
| 14 | 14 | | Sec. 552.0223. DATES OF BIRTH. Notwithstanding Section |
|---|
| 15 | 15 | | 552.101, this chapter does not authorize a governmental body to |
|---|
| 16 | 16 | | withhold a date of birth except as: |
|---|
| 17 | 17 | | (1) permitted by Section 552.102; |
|---|
| 18 | 18 | | (2) permitted by the federal privacy requirements |
|---|
| 19 | 19 | | adopted under the Health Insurance Portability and Accountability |
|---|
| 20 | 20 | | Act of 1996 (Pub. L. No. 104-191) contained in 45 C.F.R. Part 160 |
|---|
| 21 | 21 | | and 45 C.F.R. Part 164; or |
|---|
| 22 | 22 | | (3) otherwise provided by constitutional or statutory |
|---|
| 23 | 23 | | law. |
|---|
| 24 | 24 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 25 | 25 | | a request for information that is received by a governmental body or |
|---|
| 26 | 26 | | an officer for public information on or after the effective date of |
|---|
| 27 | 27 | | this Act. A request for information that was received before the |
|---|
| 28 | 28 | | effective date of this Act is governed by the law in effect on the |
|---|
| 29 | 29 | | date the request was received, and the former law is continued in |
|---|
| 30 | 30 | | effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2025. |
