77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to open meetings and public information training for
1010 certain public officials and attorneys regarding the open meetings
1111 and public information laws.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 551.005, Government Code, is amended by
1414 adding Subsection (a-1) to read as follows:
1515 (a-1) An attorney employed or engaged to assist a public
1616 official or governmental body in administering the
1717 responsibilities of the public official or governmental body under
1818 this chapter shall complete the training required by this section.
1919 The attorney must complete the training regarding the
2020 responsibilities of the governmental body and of its officers and
2121 employees under this chapter not later than the 10th day after the
2222 date the attorney is employed or engaged to assist the public
2323 official or governmental body with those responsibilities. An
2424 attorney may not be compensated by a governmental body for the time
2525 required to take and complete the training unless the attorney is an
2626 employee of the governmental body.
2727 SECTION 2. Section 552.012, Government Code, is amended by
2828 amending Subsection (c) and adding Subsection (c-1) to read as
2929 follows:
3030 (c) A public official may designate a public information
3131 coordinator to be [to satisfy the training requirements of this
3232 section for the public official if the public information
3333 coordinator is] primarily responsible for administering the
3434 responsibilities of the public official or governmental body under
3535 this chapter. Designation of a public information coordinator
3636 under this subsection does not relieve a public official from the
3737 duty to comply with this section or any other requirement of this
3838 chapter that applies to the public official. The designated public
3939 information coordinator shall complete the training course
4040 regarding the responsibilities of the governmental body with which
4141 the coordinator serves and of its officers and employees under this
4242 chapter not later than the 90th day after the date the coordinator
4343 assumes the person's duties as coordinator.
4444 (c-1) An attorney employed or engaged to assist a public
4545 official, public information coordinator, or governmental body in
4646 administering the responsibilities of the public official, public
4747 information coordinator, or governmental body under this chapter
4848 shall complete the training required by this section. The attorney
4949 must complete the training regarding the responsibilities of the
5050 governmental body and its officers and employees under this chapter
5151 not later than the 10th day after the date the attorney is employed
5252 or engaged to assist the public official, public information
5353 coordinator, or governmental body with those responsibilities. An
5454 attorney may not be compensated by a governmental body for the time
5555 required to take and complete the training unless the attorney is an
5656 employee of the governmental body.
5757 SECTION 3. (a) Each attorney described by Section
5858 551.005(a-1), Government Code, as added by this Act, who assists a
5959 public official or governmental body in administering the
6060 responsibilities of the public official or governmental body under
6161 Chapter 551 of that code on the effective date of this Act must
6262 complete the course of training required by Section 551.005 of that
6363 code on or before October 1, 2025.
6464 (b) Each attorney described by Section 552.012(c-1),
6565 Government Code, as added by this Act, who assists a public
6666 official, public information coordinator, or governmental body in
6767 administering the responsibilities of the public official, public
6868 information coordinator, or governmental body under Chapter 552 of
6969 that code on the effective date of this Act must complete the course
7070 of training required by Section 552.012 of that code on or before
7171 October 1, 2025.
7272 (c) A public official serving on the effective date of this
7373 Act who has not previously completed the training required by
7474 Section 552.012, Government Code, because the public official
7575 previously designated a public information coordinator to complete
7676 the training requirements for the public official must complete the
7777 training required by Section 552.012, Government Code, as amended
7878 by this Act, on or before January 1, 2026.
7979 SECTION 4. This Act takes effect September 1, 2025.
