611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to eligibility to use a general permit to discharge waste
914 into or adjacent to waters in this state.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 26.040, Water Code, is amended by adding
1217 Subsections (h-1) and (h-2) to read as follows:
1318 (h-1) After the commission denies or suspends a
1419 discharger's authority to discharge under a general permit under
1520 Subsection (h), the discharger may not discharge under the general
1621 permit until the executive director actively authorizes the
1722 discharger to use the general permit.
1823 (h-2) The executive director may not use an automatic
1924 process to authorize the use of a general permit under Subsection
2025 (h-1).
2126 SECTION 2. Sections 26.040(h-1) and (h-2), Water Code, as
2227 added by this Act, apply only to a denial or suspension ordered on
2328 or after the effective date of this Act.
2429 SECTION 3. This Act takes effect September 1, 2025.
