| 10 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 16 | | SECTION 1. Section 26.040, Water Code, is amended by adding |

| 12 | 17 | | Subsections (h-1) and (h-2) to read as follows: |

| 13 | 18 | | (h-1) After the commission denies or suspends a |

| 14 | 19 | | discharger's authority to discharge under a general permit under |
|---|
| 15 | 20 | | Subsection (h), the discharger may not discharge under the general |
|---|
| 16 | 21 | | permit until the executive director actively authorizes the |
|---|
| 17 | 22 | | discharger to use the general permit. |

| 18 | 23 | | (h-2) The executive director may not use an automatic |

| 19 | 24 | | process to authorize the use of a general permit under Subsection |

| 20 | 25 | | (h-1). |

| 21 | 26 | | SECTION 2. Sections 26.040(h-1) and (h-2), Water Code, as |
