77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the frequency of the notice provided to a retail
1010 electric customer by certain electric utilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 17.003(d-1), Utilities Code, is amended
1313 to read as follows:
1414 (d-1) An electric utility providing electric delivery
1515 service for a retail electric provider, as defined by Section
1616 31.002, shall provide to the retail electric provider, and the
1717 retail electric provider at least quarterly shall [periodically]
1818 provide to the retail electric provider's retail customers together
1919 with bills sent to the customers, information about:
2020 (1) the electric utility's procedures for implementing
2121 involuntary load shedding initiated by the independent
2222 organization certified under Section 39.151 for the ERCOT power
2323 region;
2424 (2) the types of customers who may be considered
2525 critical care residential customers, critical load industrial
2626 customers, or critical load according to commission rules adopted
2727 under Section 38.076;
2828 (3) the procedure for a customer to apply to be
2929 considered a critical care residential customer, a critical load
3030 industrial customer, or critical load according to commission rules
3131 adopted under Section 38.076; and
3232 (4) reducing electricity use at times when involuntary
3333 load shedding events may be implemented.
3434 SECTION 2. Section 17.005(f), Utilities Code, is amended to
3535 read as follows:
3636 (f) A municipally owned utility at least quarterly shall
3737 [periodically] provide with bills sent to retail customers of the
3838 utility information about:
3939 (1) the utility's procedure for implementing
4040 involuntary load shedding;
4141 (2) the types of customers who may be considered
4242 critical care residential customers, critical load industrial
4343 customers, or critical load according to commission rules adopted
4444 under Section 38.076;
4545 (3) the procedure for a customer to apply to be
4646 considered a critical care residential customer, a critical load
4747 industrial customer, or critical load according to commission rules
4848 adopted under Section 38.076; and
4949 (4) reducing electricity use at times when involuntary
5050 load shedding events may be implemented.
5151 SECTION 3. Section 17.006(f), Utilities Code, is amended to
5252 read as follows:
5353 (f) An electric cooperative at least quarterly shall
5454 [periodically] provide with bills sent to retail customers of the
5555 cooperative information about:
5656 (1) the cooperative's procedure for implementing
5757 involuntary load shedding;
5858 (2) the types of customers who may be considered
5959 critical care residential customers, critical load industrial
6060 customers, or critical load according to commission rules adopted
6161 under Section 38.076;
6262 (3) the procedure for a customer to apply to be
6363 considered a critical care residential customer, a critical load
6464 industrial customer, or critical load according to commission rules
6565 adopted under Section 38.076; and
6666 (4) reducing electricity use at times when involuntary
6767 load shedding events may be implemented.
6868 SECTION 4. This Act takes effect September 1, 2025.
