77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the disconnection of electric service by certain
1010 entities during an extreme weather emergency.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.101(h), Utilities Code, is amended to
1313 read as follows:
1414 (h) A retail electric provider, power generation company,
1515 aggregator, or other entity that provides retail electric service
1616 may not disconnect service to a residential customer during an
1717 extreme weather emergency or on a weekend day. The entity providing
1818 service shall defer collection of the full payment of bills that are
1919 due during an extreme weather emergency until after the emergency
2020 is over and shall work with customers to establish a pay schedule
2121 for deferred bills. For purposes of this subsection, "extreme
2222 weather emergency" means a period when:
2323 (1) the previous day's highest temperature did not
2424 exceed 32 degrees Fahrenheit and the temperature is predicted to
2525 remain at or below that level for the next 24 hours according to the
2626 nearest National Weather Service reports; [or]
2727 (2) the National Weather Service issues a heat
2828 advisory for any county in the relevant service territory, or when
2929 such an advisory has been issued on any one of the previous two
3030 calendar days; or
3131 (3) any county in the relevant service territory is
3232 the subject of a weather-related disaster declaration by the
3333 governor under Chapter 418, Government Code.
3434 SECTION 2. This Act takes effect September 1, 2025.
