11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter H, Chapter 161, Health and Safety | |
13 | 13 | Code, is amended by adding Section 161.0877 to read as follows: | |
14 | 14 | Sec. 161.0877. PROHIBITED ENTRY OF MINORS ON PREMISES OF | |
15 | 15 | SMOKE SHOPS; CRIMINAL OFFENSE. (a) In this section, "smoke shop" | |
16 | 16 | means an establishment for which the gross receipts from the retail | |
17 | 17 | sale of cigarettes, e-cigarettes, or tobacco products on the | |
18 | 18 | establishment's premises is at least 50 percent of the total gross | |
19 | 19 | receipts from the retail sale of all items on the premises. | |
20 | 20 | (b) An employee or owner of a smoke shop may not allow a | |
21 | 21 | minor to enter the premises of the smoke shop unless the minor is | |
22 | 22 | accompanied by the minor's adult parent or guardian. | |
23 | 23 | (c) An employee or owner of a smoke shop commits an offense | |
24 | 24 | if the employee or owner knowingly violates this section. An | |
25 | 25 | offense under this subsection is a misdemeanor punishable by a fine | |
26 | 26 | not to exceed $500. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
