88 AN ACT
99 relating to limitations on the age of individuals allowed to enter
1010 the premises of a smoke shop; creating a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter H, Chapter 161, Health and Safety
1313 Code, is amended by adding Section 161.0877 to read as follows:
1414 Sec. 161.0877. PROHIBITED ENTRY OF MINORS ON PREMISES OF
1515 SMOKE SHOPS; CRIMINAL OFFENSE. (a) In this section, "smoke shop"
1616 means an establishment for which the gross receipts from the retail
1717 sale of cigarettes, e-cigarettes, or tobacco products on the
1818 establishment's premises is at least 50 percent of the total gross
1919 receipts from the retail sale of all items on the premises.
2020 (b) An employee or owner of a smoke shop may not allow a
2121 minor to enter the premises of the smoke shop unless the minor is
2222 accompanied by the minor's adult parent or guardian.
2323 (c) An employee or owner of a smoke shop commits an offense
2424 if the employee or owner knowingly violates this section. An
2525 offense under this subsection is a misdemeanor punishable by a fine
2626 not to exceed $500.
2727 SECTION 2. This Act takes effect September 1, 2025.
