6	9		A BILL TO BE ENTITLED
7	10		AN ACT
8	11		relating to compensation and leave for certain peace officers.
9	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	13		SECTION 1. Section 659.301(5), Government Code, is amended
11	14		to read as follows:
12	15		(5) "State employee" means an individual who:
13	16		(A) is a commissioned law enforcement officer of
14	17		the Department of Public Safety, the Texas Facilities Commission,
15	18		the Texas Alcoholic Beverage Commission, the Texas Department of
16	19		Criminal Justice, the attorney general, the Texas Commission on Law
17	20		Enforcement, or the insurance fraud unit of the Texas Department of
18	21		Insurance;
19	22		(B) is a commissioned security officer of the
20	23		comptroller;
21	24		(C) is a law enforcement officer commissioned by
22	25		the Parks and Wildlife Commission;
23	26		(D) is a commissioned peace officer of an
24	27		institution of higher education;
25	28		(E) is an employee or official of the Board of
26	29		Pardons and Paroles or the parole division of the Texas Department
27	30		of Criminal Justice if the employee or official has routine direct
28	31		contact with inmates of any penal or correctional institution or
29	32		with administratively released prisoners subject to the board's
30	33		jurisdiction;
31	34		(F) has been certified to the Employees
32	35		Retirement System of Texas under Section 815.505 as having begun
33	36		employment as a law enforcement officer or custodial officer,
34	37		unless the individual has been certified to the system as having
35	38		ceased employment as a law enforcement officer or custodial
36	39		officer;
37	40		(G) before May 29, 1987, received hazardous duty
38	41		pay based on the terms of any state law if the individual holds a
39	42		position designated under that law as eligible for the pay; or
40	43		(H) is a security officer employed by the Texas
41	44		Military Department.
42	45		SECTION 2. Section 661.918(a), Government Code, is amended
43	46		to read as follows:
44	47		(a) This section applies to a peace officer under Article
45	48		2A.001, Code of Criminal Procedure, who is commissioned as a law
46	49		enforcement officer or agent, including a ranger, by:
47	50		(1) the Public Safety Commission and the director of
48	51		the Department of Public Safety;
49	52		(2) the Parks and Wildlife Commission;
50	53		(3) the Texas Alcoholic Beverage Commission;
51	54		(4) the attorney general; [or]
52	55		(5) the insurance fraud unit of the Texas Department
53	56		of Insurance; [or]
54	57		(6) the comptroller; or
55	58		(7) the Texas Commission on Law Enforcement.
56	59		SECTION 3. Section 1701.160, Occupations Code, is amended
57	60		to read as follows:
58	61		Sec. 1701.160. AUTHORITY TO COMMISSION INVESTIGATORS AS
59	62		PEACE OFFICERS. (a) The commission may commission certified peace
60	63		officers as investigators employed by the commission for the
61	64		limited purpose of assisting the commission in administering this
62	65		chapter.
63	66		(b) The commission shall ensure a peace officer
64	67		commissioned under Subsection (a) is compensated according to
65	68		Schedule C of the position classification salary schedule
66	69		prescribed by the General Appropriations Act.
67	70		SECTION 4. (a) The classification officer in the office of
68	71		the state auditor shall classify the position of commissioned peace
69	72		officer employed by the Texas Commission on Law Enforcement as a
70	73		Schedule C position under the position classification plan
71	74		maintained under Chapter 654, Government Code.
72	75		(b) The change made by the classification officer as
73	76		required by this section applies beginning with the state fiscal
74	77		biennium beginning September 1, 2025.
75	78		(c) This section expires September 1, 2027.
76	79		SECTION 5. Section 661.918(a), Government Code, as amended
77	80		by this Act, applies only to an injury that occurs on or after the
78	81		effective date of this Act.
79	82		SECTION 6. This Act takes effect September 1, 2025.
