88 AN ACT
99 relating to the cremation of human remains by alkaline hydrolysis.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 711.001(11), (12), and (13), Health and
1212 Safety Code, are amended to read as follows:
1313 (11) "Cremated remains" or "cremains" means the
1414 essential elements, including bone fragments, remaining after the
1515 cremation process, which may include the residue of any foreign
1616 materials that were cremated with the human remains.
1717 (12) "Cremation" means the irreversible process of
1818 reducing human remains to essential elements, including bone
1919 fragments, through extreme heat and evaporation or through alkaline
2020 hydrolysis. The process[, which] may include the processing or the
2121 pulverization of bone fragments.
2222 (13) "Crematory" means a structure containing a
2323 furnace or alkaline hydrolysis vessel used or intended to be used
2424 for the cremation of human remains. The term includes a facility
2525 used to cremate human remains through alkaline hydrolysis.
2626 SECTION 2. Section 716.001(5), Health and Safety Code, is
2727 amended to read as follows:
2828 (5) "Cremation" means the irreversible process of
2929 reducing human remains to essential elements, including bone
3030 fragments, through direct flame, extreme heat, and evaporation or
3131 through alkaline hydrolysis. The term may include pulverization,
3232 which is the process of reducing identifiable bone fragments after
3333 cremation and processing granulated particles by manual or
3434 mechanical means.
3535 SECTION 3. Section 716.002, Health and Safety Code, is
3636 amended to read as follows:
3737 Sec. 716.002. CREMATION RULES. (a) The commission may
3838 adopt rules consistent with this chapter and Chapter 651,
3939 Occupations Code, to govern the cremation of human remains.
4040 (b) Notwithstanding the provisions of this chapter and
4141 Chapter 651, Occupations Code, the commission may modify cremation
4242 procedures and requirements under Subchapter D to the extent
4343 necessary to allow cremation through alkaline hydrolysis.
4444 SECTION 4. Subchapter D, Chapter 716, Health and Safety
4545 Code, is amended by adding Section 716.1525 to read as follows:
4646 Sec. 716.1525. ALKALINE HYDROLYSIS CREMATION.
4747 Notwithstanding Sections 716.151 and 716.152, the commission by
4848 rule shall establish the requirements for cremation through
4949 alkaline hydrolysis, including rules for the cremation process and
5050 for containers used in the process.
5151 SECTION 5. Section 651.001(3), Occupations Code, is amended
5252 to read as follows:
5353 (3) "Crematory" means a structure containing a furnace
5454 or alkaline hydrolysis vessel used or intended to be used for the
5555 cremation of human remains. The term includes a facility used to
5656 cremate human remains through alkaline hydrolysis.
5757 SECTION 6. Section 651.651(1), Occupations Code, is amended
5858 to read as follows:
5959 (1) "Cremation" means the irreversible process of
6060 reducing human remains to essential elements, including bone
6161 fragments, through direct flame, extreme heat, and evaporation or
6262 through alkaline hydrolysis. The term may include pulverization,
6363 which is the process of reducing identifiable bone fragments after
6464 cremation and processing granulated particles by manual or
6565 mechanical means.
6666 SECTION 7. Not later than December 1, 2025, the Texas
6767 Funeral Service Commission shall adopt rules to implement the
6868 changes in law made by this Act.
6969 SECTION 8. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2025.
