77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the repeal of a municipal civil service system for
1010 firefighters and police officers in certain municipalities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 143.004(e), Local Government Code, is
1313 amended to read as follows:
1414 (e) If the governing body of a municipality with a
1515 population of less than 70,000 [950,000] that has operated under
1616 this chapter for at least one year receives a petition requesting an
1717 election to repeal this chapter that is signed by at least 10
1818 percent of the qualified voters of the municipality, the governing
1919 body shall order an election submitting to the voters the question
2020 on whether this chapter should be repealed. If a majority of the
2121 qualified voters vote to repeal this chapter, this chapter is void
2222 in that municipality.
2323 SECTION 2. The change in law made by this Act applies only
2424 to a petition for which an election has not been ordered before the
2525 effective date of this Act. A petition for which an election has
2626 been ordered before the effective date of this Act is governed by
2727 the law in effect when the election was ordered, and the former law
2828 is continued in effect for that purpose.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2025.
