77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the amount of certain awards under the Crime Victims'
1010 Compensation Act.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Articles 56B.106(b) and (e), Code of Criminal
1313 Procedure, are amended to read as follows:
1414 (b) In addition to an award payable under Subsection (a),
1515 the attorney general may award not more than $100,000 [$75,000] for
1616 extraordinary pecuniary loss if the personal injury to a victim is
1717 catastrophic and results in a total and permanent disability to the
1818 victim. An award described by this subsection may be made for lost
1919 wages and the reasonable and necessary costs of:
2020 (1) making a home or motor vehicle accessible;
2121 (2) obtaining job training and vocational
2222 rehabilitation;
2323 (3) training in the use of a special appliance;
2424 (4) receiving home health care;
2525 (5) durable medical equipment;
2626 (6) rehabilitation technology; and
2727 (7) long-term medical expenses incurred as a result of
2828 medically indicated treatment for the personal injury.
2929 (e) The attorney general by rule may establish a limitation
3030 on any other pecuniary loss compensated under this chapter,
3131 including a limitation on pecuniary loss incurred as a result of a
3232 claimant's travel to and attendance of a deceased victim's funeral.
3333 A limitation established under this subsection on pecuniary loss
3434 incurred for funeral and burial expenses, including expenses
3535 related to a claimant's travel to and attendance of a deceased
3636 victim's funeral, may not be less than $9,000.
3737 SECTION 2. The change in law made by this Act applies only
3838 to compensation for criminally injurious conduct occurring on or
3939 after the effective date of this Act. Compensation for criminally
4040 injurious conduct occurring before the effective date of this Act
4141 is governed by the law in effect on the date the conduct occurred,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, criminally injurious conduct occurred
4444 before the effective date of this Act if any element of the offense
4545 underlying the conduct occurred before that date.
4646 SECTION 3. This Act takes effect September 1, 2025.
